This new study of the Meiji Government's controversial Education Minister and thinker, Mori Arinori, seeks to complement Ivan P. Hall's excellent earlier biography (1973) by providing an alternative interpretation of the man and his mission, namely that he is 'overwhelmingly closer to the social evolutionist's view of social change', with a considerable debt to the writings of Spencer rather than the Utalitarian philosophy of J. S. Mill. In other words, Mori was able to develop a workable philosophy of government and administration in line with the pragmatic needs of Japanese society. The book, therefore, will contribute to a radical rethink of Japanese perceptions of the Meiji reforms seen in their own terms.

This set of essays explores how constitutions change and are changed in a number of countries, and how the 'constitution' of the EU changes and is changed. For a range of reasons, including internal and external pressures, the constitutional arrangements in many countries are changing. Constitutional change may be formal, involving amendments to the texts of Constitutions or the passage of legislation of a clearly constitutional kind, or informal and organic, as where court decisions affect the operation of the system of government, or where new administrative and other arrangements (eg agencification) affect or articulate or alter the operation of the constitution of the country, without the need to resort to formal change. The countries in this study include, from the EU, a common law country, a Nordic one, a former communist state, several civil law systems, parliamentary systems and a hybrid one (France). Chapters on non EU countries include two on developing countries (India and South Africa), two on common law countries without entrenched written constitutions (Israel and New Zealand), a presidential system (the USA) and three federal ones (Switzerland, the USA and Canada). In the last two chapters the editors conduct a detailed comparative analysis of the jurisdiction-based chapters and explore the question whether any overarching theory or theories about constitutional change in liberal democracies emerge from the study.

Interactions between state, international, transnational, and intra-state law involve overlapping, and sometimes conflicting, claims to legitimate authority. This has led scholars to new theoretical explanations of sovereignty, constitutionalism, and legality, but there has been little treatment of authority itself. This book asks whether, and under what conditions, there can be multiple legitimate authorities with overlapping or conflicting domains. Can legitimate authority be shared between state, supra-state, and non-state actors, and if so, how should they relate to one another? Roughan argues that understanding authority in contemporary pluralist circumstances requires a new conception of relative authority, and a new theory of its legitimacy. The theory of relative authority treats the interdependence of authorities, and the relationships in which they are engaged, as critical to any assessment of their legitimacy. It offers a tool for evaluating inter-authority relationships prevalent in international, transnational, state, and non-state constitutional practice, while suggesting significant revisions to the idea that law, in general or even by necessity, claims to have legitimate authority.

Issues of legitimacy became more directly associated with the link between parliament and citizens, resulting in investment in new and more complex mechanisms for contact with citizens, even in the more centralised systems. This book looks at a wide range of case studies across Europe and beyond, assessing overall strategies in the move towards stronger engagement with citizens.
