"El estudio que ahora presento al lector tiene su origen en la lección magistral que pronuncié el 13 de enero de 1966 en la Facultad de Derecho y Ciencias Políticas de la Universidad Albert Ludwig de Freiburg im Breisgau. He efectuado ciertas precisiones y adjuntado la documentación que acompaña al texto. Pero he conservado el estilo expositivo de la conferencia. Lo cual debe aclarar también que la tradicional y muy discutida partición dualista del Derecho no se estudia aquí con pretensiones de exhaustividad, sino que tan solo se examina a grandes rasgos su condicionamiento histórico y se revisa y cuestiona básicamente su sentido y funcionalidad respecto del ordenamiento jurídico de la hora presente. Se esbozan, pero no se perfilan con completitud, las posibilidades y ventajas de una comprensión escasamente esquemática y un mucho funcional de lo jurídico.
