Between 1989 and 2004, the EU's conditionality for membership transformed Central and East Europe. The EU had enormous potential power over the whole range of domestic politics in the candidate countries. However, the EU was able to use that power at a few key points in the process leading to their accession. The EU's long-term influence worked primarily through soft power and through voluntary rather than coercive means. During the membership preparations, the EU built many different routes of influence into the candidate countries' domestic policy-making through 'Europeanization'. The Central and East Europeans voluntarily took on the Union's norms and methods, guided by the European Commission, in a massive transfer of policies and institutions. However, the EU missed important opportunities to effect change as well. The EU's Transformative Power explores in detail how the EU used its influence to control the movement of people across Europe, through both coercive use of conditionality and voluntary methods of Europeanization.

The Charter of Fundamental Rights of the European Union enshrines the key political, social and economic rights of EU citizens and residents in EU law. In its present form it was approved in 2000 by the European Parliament, the Council of Ministers and the European Commission. However its legal status remained uncertain until the entry into force of the Treaty of Lisbon in December 2009. The Charter obliges the EU to act and legislate consistently with the Charter, and enables the EU's courts to strike down EU legislation which contravenes it. The Charter applies to EU Member States when they are implementing EU law but does not extend the competences of the EU beyond the competences given to it in the treaties. This Commentary on the Charter, the first in English, written by experts from several EU Member States, provides an authoritative but succinct statement of how the Charter impacts upon EU, domestic and international law. Following the conventional article-by-article approach, each commentator offers an expert view of how each article is either already being interpreted in the courts, or is likely to be interpreted. The European Union is a supranational organisation with a set of circumscribed powers. Although these powers do not include an all-encompassing fundamental rights' mandate, today's existential challenges - from economic to refugee crisis, via concerns for compliance with the rule of law in some of its Member States - increase the pressure on the EU to develop tools for protection and promotion of such rights. One way of addressing the tension between the lack of a general mandate and vivid calls for protection is for the EU to focus on selected fundamental rights which it has competence to regulate. One such example is EU law on the fundamental right to equal treatment that has blossomed since the late 1990s. In developing selected fundamental right policies that can be imposed on domestic actors, as EU law does, supranational intervention needs to be carefully tailored to the plural landscape where they are intended to flourish. This monograph calls for a nuanced use of the infrastructure of EU law to convey shared values at domestic level across Europe.

This book inquires into the competence of the EU to legislate in the field of copyright, and uses content analysis techniques to demonstrate the existence of a normative gap in copyright lawmaking. To address that gap, it proposes the creation of benchmarks of legislative activity, reasoning that EU secondary legislation, such as directives and regulations, should be based on higher sources of law. It investigates two such possible sources: the activity of the EU Court of Justice in the pre-legislative era and the EU treaties. From these sources, the author establishes concrete benchmarks of legislative activity, which she then tests by applying them to current EU copyright legislation. This provides examples of good and bad practices in copyright lawmaking and also shows how the benchmarks could be implemented in copyright legislation. Finally, the author offers some recommendations in this regard.

This book examines how mass media debates have contributed to the politicization of the European Union. The public controversies over the EU’s attempted Constitution-making (and its failure) sowed the seeds for a process of politicization that has advanced ever since: an increasing visibility for the EU in mass-mediated public debates that is combined with a growing public contestation over Europe within national politics. The book presents an original systematic study of the emerging field of political discourse carried by the mass media in France, Germany and Britain to examine the performance of Europe’s public sphere. Whilst the EU’s increasing politicization can be seen as beneficial to European democracy, potentially ‘normalizing’ the EU-level within national politics, the same developments can also be a threat to democracy, leading to populist and xenophobic responses and a decline in political trust.
