Schon seit Beginn der Bundesrepublik Deutschland besteht ein Spannungsverh„ltnis zwischen dem im Grundgesetz Artikel 38 (1) verankerten Recht des Abgeordneten, seine Entscheidungen seinem Gewissen entsprechend zu treffen, ohne an Auftr„ge und Weisungen gebunden zu sein, und dem Anspruch der Fraktion genau dieses einzuschr„nken. Im Kontext der historischen Entwicklung und den im Grundgesetz verankerten und verfestigten Werten, den sich daraus ergebenden Verhaltenserwartungen sowie den damit verbundenen Normen und Normengefgen hat sich diese Studienarbeit zur Aufgabe gemacht - jedenfalls soweit dies der Rahmen zul„sst - zu untersuchen, ob und inwiefern ein Prozess von Normverselbstst„ndigung stattgefunden hat bzw. gerade stattfindet. Die Fragen, die dabei von zentraler Bedeutung sind, lauten: K”nnen sich Normen oder Normengefge so weit von ihrem ursprnglichen Zweck entfernen, k”nnen sie eine Eigendynamik entfalten, die sich letztendlich gegen die Menschen und ihre Interessen wendet? Oder ist dieser Prozess vielmehr eine Notwendigkeit, ein Anpassungsprozess? Wann wird eine Norm zur Gefahr? Diese Fragen versucht diese Arbeit am Beispiel von Artikel 38 (1) GG versus dem Fraktionszwang auf den Grund zu gehen.

This book presents the first comprehensive analysis of the second International Self-Report Delinquency study (ISRD-2). An earlier volume, Juvenile Delinquency in Europe and Beyond (Springer, 2010) focused mainly on the findings with regard to delinquency, victimization and substance use in each of the individual participating ISRD-2 countries. The Many Faces of Youth Crime is based on analysis of the merged data set and has a number of unique features: The analyses are based on an unusually large number of respondents (about 67,000 7th, 8th and 9th graders) collected by researchers from 31 countries; It includes reports on the characteristics, experiences and behaviour of first and second generation migrant youth from a variety of cultures; It is one of the first large-scale international studies asking 12-16 year olds about their victimization experiences (bullying, assault, robbery, theft); It describes both intriguing differences between young people from different countries and country clusters in the nature and extent of delinquency, victimization and substance use, as well as remarkable cross-national uniformities in delinquency, victimization, and substance use patterns; A careful comparative analysis of the social responses to offending and victimization adds to our limited knowledge on this important issue; Detailed chapters on the family, school, neighbourhood, lifestyle and peers provide a rich comparative description of these institutions and their impact on delinquency; It tests a number of theoretical perspectives (social control, self-control, social disorganization, routine activities/opportunity theory) on a large international sample from a variety of national contexts; It combines a theoretical focus with a thoughtful consideration of the policy implications of the findings; An extensive discussion of the ISRD methodology of ‘flexible standardization’ details the challenges of comparative research. The book consists of 12 chapters, which also may be read individually by those interested in particular special topics (for instance, the last chapter should be of special interest to policy makers). The material is presented in such a way that it is accessible to more advanced students, researchers and scholars in a variety of fields, such as criminology, sociology, deviance, social work, comparative methodology, youth studies, substance use studies, and victimology.

This book examines the idea of a fundamental entitlement to health and healthcare from a human rights perspective. The volume is based on a particular conceptual reasoning that balances critical thinking and pragmatism in the context of a universal right to health. Thus, the primary focus of the book is the relationship or contrast between rights-based discourse/jurisprudential arguments and real-life healthcare contexts. The work sets out the constraints that are imposed on a universal right to health by practical realities such as economic hardship in countries, lack of appropriate governance, and lack of support for the implementation of this right through appropriate resource allocation. It queries the degree to which the existence of this legally enshrined right and its application in instruments such as the International Covenant on Economic, Social and Cultural Rights (ICESCR) and the Universal Declaration of Human Rights (UDHR) can be more than an ephemeral aspiration but can, actually, sustain, promote, and instil good practice. It further asks if social reality and the inequalities that present themselves therein impede the implementation of laudable human rights, particularly within marginalised communities and cadres of people. It deliberates on what states and global bodies do, or could do, in practical terms to ensure that such rights are moved beyond the aspirational and become attainable and implementable. Divided into three parts, the first analyses the notion of a universal inalienable right to health(care) from jurisprudential, anthropological, legal, and ethical perspectives. The second part considers the translation of international human rights norms into specific jurisdictional healthcare contexts. Finally, the third part summarises the lessons learnt and provides a pathway for future action.
