"El fundamento de la gestión de negocios ajenos, aun gloriándose de una milenaria tradición, está hoy todavía vivo y vital, no sólo porque los modernos Códigos civiles, como el nuestro actual y el precedente, la hacen objeto de disciplina minuciosa y general-mente apropiada, sino también por la multiplicidad de sus aplicaciones en la varia trama de las relaciones económicas, así como por las interesantes investigaciones doctrinales que se pueden reunir a fin de aclarar su naturaleza jurídica y su relación con muchas otras instituciones afines, entre las cuales la tan teórica-mente vejada de la representación. Mucho más que, abandonada por nuestro sistema vigente la híbrida concepción del cuasicontrato, en el cual la gestión era encasillada por el abrogado Código, se acrecienta la dificultad de su colocación en el amplio cuadro de los hechos jurídicos y de las varias especies en que los «voluntarios» se pueden clasificar. Pero otra consideración hace oportuno, a nuestro parecer, el cuidadoso examen del tema en cuestión. Las obras de algún relieve y extensión que del mismo tratan en Italia, remontan a varios decenios. Por tanto, no nos ha parecido superfluo el presente tratado, que, sin querer asumir la respetable mole de un volumen «panzudo», se ha propuesto desarrollar el tema con plan ordenado y en estilo claro y compendioso, aunque no omitiendo mencionar e intentar resolver los más interesantes «casos clínicos» de que está esparcido tan fértil terreno. Si hubiéramos logrado además adelantar un pequeño paso en el estudio orgánico del tema, encontraríamos el mejor premio a nuestro trabajo". Giorgio de Semo.
