Following on from a Green Paper (Cm. 7170, ISBN 9780101717021) published in July 2007, this consultation document discusses ways of making the executive branch of government more accountable, focusing on two areas: the power to enter into international obligations (treaties) and the power to engage the country in war. Although these are two of the most important powers a government can wield, there is no legal requirement for the House of Commons to have any particular role in these decisions, with the executive traditionally deriving its powers from the ancient prerogatives of the Crown. This consultation paper considers how the role of Parliament can be strengthened in the conduct of diplomacy and armed conflict, whilst balancing this against the need for government to take swift action to protect national security and other national interests, and avoiding undermining operational security and effectiveness. The consultation period ends on 17/01/2008.

Fresh, modern, and practical, Public Law provides law undergraduates with a unique approach to constitutional and administrative law, aptly demonstrating why this is an exciting time to be studying the subject. Writing in a fluid, succinct style, the authors carve a logical pathway through the key areas studied on the LLB, guiding students to a solid understanding of the fundamental principles. This theoretical grounding is then rooted in reality, with each concept applied to a hypothetical scenario (included at the start of each chapter) to set it into a practical context. While this practical element helps students to understand how the law applies and develop problem-solving skills, a trio of supportive learning features also encourages active engagement with and a critical appreciation of public law. 'Key case' boxes highlight and analyse the significant case law in each area; 'Counterpoint' boxes flag alternative viewpoints and areas of debate; and 'Pause for reflection' boxes prompt readers to consider the impact of laws, and what potential developments and reforms may lie ahead. Public Law's modern approach and unique combination of practical application and theoretically critical discussion makes it the ideal choice for students seeking to understand concepts not only in the abstract but in practice, helping them to develop the skills they need to succeed at university and beyond. Digital formats and resources This third edition is supported by online resources and is available for students or institutions to purchase in a variety of digital formats. - The e-book offers a mobile experience and convenient access along with functionality tools, navigation features and links that offer extra learning support: www.oxfordtextbooks.co.uk/ebooks - Online resources to support the book feature multiple choice questions, guidance on approaching and analysing the real life scenarios in the book, legal updates, and links to useful material elsewhere on the web.

Interpretive Political Science is the second of two volumes featuring a selection of key writings by R.A.W. Rhodes. Volume II looks forward and explores the 'interpretive turn' and its implications for the craft of political science, especially public administration, and draws together articles from 2005 onwards on the theme of 'the interpretive turn' in political science. Part I provides a summary statement of the interpretive approach, and Part II develops the theme of blurring genres and discusses a variety of research methods common in the humanities, including: ethnographic fieldwork, life history, and focus groups. Part III demonstrates how the genres of thought and presentation found in the humanities can be used in political science. It presents four examples of such blurring 'at work' with studies of: applied anthropology and civil service reform; women's studies and government departments; and storytelling and local knowledge. The book concludes with a summary of what is edifying about an interpretive approach, and why this approach matters, and revisits some of the more common criticisms before indulging in plausible conjectures about the future of interpretivism. The author seeks new and interesting ways to explore governance, high politics, public policies, and the study of public administration in general. Volume I collects in one place for the first time the main articles written by Rhodes on policy networks and governance between 1990 and 2005, and explores a new way of describing British government, focusing on policy making and the ways in which policy is put into practice.

Britain's participation in the Iraq war defines one of the most tumultuous periods in its political history. Driven by a desire to enhance the influence of the British government on the world stage, the decision to support the US-led invasion has severely disrupted the stability of international relations, produced rising disenchantment with the domestic political process, and has threatened to undermine the continued viability of the New Labour project. Yet these developments are also indicative of a far-deeper malaise. The events surrounding the war have clearly exposed the flaws and weaknesses that are inherent within the British democratic system. A deep-seated adherence to a top-down style of policy-making at the expense of more participatory and accountable forms of governance has been amplified by the internal structures of the New Labour government itself. The consequences have left an indelible mark on Britain's political landscape that will endure for many years.

English Administrative Law From 1550 written by Paul Craig and has been published by Oxford University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2024-05-09 with Law categories.

The commonly held view about English administrative law is that it is of recent origin, with some dating it from the mid-20th century and some venturing back to the late 19th century. English Administrative Law from 1550: Continuity and Change upends this conventional thinking, charting its development from the mid-16th century with an in-depth examination of administrative law doctrine based on primary legal materials, statute, and case law. This book is divided into four parts. Part 1 sets out the book's principal thesis, contrasting standard perceptions concerning the existence of English administrative law with the reality of its emergence from the mid-16th century. Part 2 is concerned with Regulation and Administration from the mid-16th century to the end of the 19th century. There is detailed analysis of the regulatory and administrative state, which includes chapters on the way in which administrative policy was developed through individual decision-making and rulemaking, and the role played by contract in service delivery. Part 3 deals with Courts and Doctrine. It begins with discussion of foundational precepts followed by chapters on natural justice; review of law and fact; rights; delegation, fettering and purpose; reasonableness; proportionability; prerogative; and third and fourth source power. Part 4 of the book covers Remedies and Review, with chapters on invalidity; standing; the prerogative writs; injunction, declaration, quo warranto and habeas corpus; and damages and restitutionary liability. With thought-provoking and original insights, English Administrative Law from 1550 systematically elaborates and contextualizes the origins of administrative law features while linking them to their modern-day equivalents.
