La declaración de herederos abintestato consiste en un procedimiento especial, que se tramita por vía notarial, generalmente instado por quienes se consideran herederos de una persona que ha fallecido sin haber otorgado un testamento o contrato sucesorio y también, cuando así lo admite la ley aplicable a la sucesión, en aquellos supuestos en que el fallecido no ha dispuesto de la totalidad de los bienes que constituyen su herencia, y que legitima a los familiares o parientes del causante que aparecen designados como herederos abintestato en el título sucesorio, para actuar y ejercitar sus derechos con tal carácter en el tráfico jurídico.
