Este libro se dirige a los alumnos de Teoría del Estado I: el Estado y sus instituciones. Su finalidad es la de proporcionar el marco teórico que permita analizar los cambios contemporáneos, así como la persistencia de las instituciones que caracterizan la organización estatal. Su contenido se centra, por una parte, en el estudio de los procesos e ideas que propiciaron el surgimiento y las transformaciones del Estado hasta definirse como un Estado de derecho, democrático y de bienestar, y por otra, en su organización. "El tema del Estado, eternamente presente al pensamiento, se presenta hoy como verdaderamente central, hasta el punto de que no hay sistema de ética que de él prescinda, coloreando, con las exigencias que impone y las soluciones que ofrece, otros problemas de la práctica. Es mérito, en efecto, del idealismo contemporáneo haber reivindicado, tras contingentes denegaciones, la plena espiritualidad del Estado, haber concebido el Estado en el mundo de la acción, él mismo como acción, como complejo de acciones, como voluntad que es pensamiento y pensamiento que se pone como voluntad, como consecuencia, en una palabra. Y estas ideas están tan generalmente difundidas y mantenidas, que podría parecer casi innecesario el volver sobre ellas si no fuese porque consideramos útil examinarlas bajo otros aspectos, en relación a argumentos particulares que sobreentienden ciertamente la referida espiritualidad del Estado, pero que creemos oportuno iluminar ahora de modo especial. La intimidad del Estado respecto a la consciencia podemos afirmar que es una lenta conquista del espíritu humano. Evoluciona y se afirma con éste, que en cuanto pensamiento quiere penetrar lo real y lo llena de sí hasta descubrir, no sólo que no es extraño a él, sino incluso que no hay nada real que él mismo no haga nacer en su incansable productividad, siendo precisamente real en tanto en cuanto es pensamiento".
