Rafael Leal-Arcas expertly examines the interface of climate change mitigation and international trade law with a view to addressing the question: How can we make best use of the international trading system experience to aim at a global climate change agreement? The insightful book contributes to developing the architecture for a post- 2012 global climate agreement and, in doing so, seeks and proposes new approaches to climate change mitigation by linking it to the international trade system. The author suggests the adoption of a bottom-up approach to climate change negotiations by using the evolution of multilateral trade agreements as a model for reaching a global climate treaty. He discusses the innovative approach of inserting climate goals within regional trade agreements, given their proliferation – especially bilateral – in the international trading system. He explains the trade implications of climate change mitigation policies by analyzing a couple of areas where the international regimes for trade and climate change mitigation may potentially clash. Climate Change and International Trade will strongly appeal to undergraduate and graduate students of international and European trade law, international and European environmental law as well as social science academics. NGOs, think tanks, practitioners, researchers, and international organizations will also find plenty of valuable information in this timely resource.

The mushrooming of trade agreements and their interlinkages with environmental governance calls for new research on the trade and environment interface. The more than 700 existing preferential trade agreements (PTAs) include ever more diverse and far-reaching environmental provisions. While missed opportunities remain and harmful provisions persist, numerous environmental provisions in PTAs entail promising potential. They promote the implementation of environmental treaties and cover numerous environmental issues. New concepts, data, and methods, including detailed content analysis across multiple institutions, are needed to explain these interlinkages and understand whether and how PTAs with environmental provisions can contribute to tackling global environmental challenges. Making use of the most extensive coding of environmental provisions in PTAs to date and combining quantitative data with qualitative analyses, this Element provides a comprehensive yet fine-grained picture of the drivers and effects of environmental provisions in PTAs. This title is also available as Open Access on Cambridge Core.

Emerging Issues In Sustainable Development written by Mitsuo Matsushita and has been published by Springer this book supported file pdf, txt, epub, kindle and other format this book has been release on 2016-10-05 with Business & Economics categories.

This book seeks to answer the questions: how do the rules of international treaties on trade and investment apply to the new laws and policies relating to energy-related trade, and do the rules of the multilateral system contribute to or detract from sustainable development? An emerging set of new problems in the law of international trade is how to reconcile the rules of the multilateral trading system with shortages of certain natural resources and the necessity to develop renewable energy resources. The chapters in this book provide a comprehensive analysis of the international trade issues presented by national trade laws and policies with regard to natural resources and energy. This book is about the extent to which we are interpreting existing rules to cover emerging problems and how the rules of the multilateral trading system can be adapted to achieve sustainable development in natural resources and energy. The book begins with a survey of selected national laws relating to recent restrictions on the export of natural resources, both resources used to produce energy as well as natural resources essential for industrial production. After examining the range of such laws in selected important countries, we turn to the application of the rules of the multilateral trading system to such export restrictions. We discuss the major rules of the World Trade Organization (WTO) as well as the natural resources rules in selected regional preferential free trade agreements. While there is not a comprehensive global legal regime on competition law, we believe it is also important to examine how selected national competition laws impact export restrictions on natural resources. This book will be a major contribution to the international dialogue on international economic law issues with respect to trade in natural resources and energy.

Trade And The Environment written by Durwood Zaelke and has been published by this book supported file pdf, txt, epub, kindle and other format this book has been release on 1993-10 with Law categories.

Trade and the Environment is an important primer for anyone concerned with the impact of trade agreements on the global environment. After examining some of the broader aspects of the debate, the book turns to specific concerns: When is it appropriate for one country to use trade measures to influence industrial behavior in another country? How are international environmental standards set? When are low environmental standards in one country a subsidy to that country's industries? With chapters representing the views of industrial leaders, trade advocates, environmentalists, international organizations, and policymakers from both the developed and developing world, Trade and the Environment provides insight into the full spectrum of issues, concerns, and parties involved in this critical debate.
