German constitutionalism has gained a central place in the global comparative debate, but what underpins it remains imperfectly understood. Its distinctive conception of the rule of law and the widespread support for its powerful Constitutional Court are typically explained in one of two ways: as a story of change in reaction to National Socialism, or as the continuation of an older nineteenth-century line of constitutional thought that emphasizes the function of constitutional law as a constraint on state power. But while both narratives account for some important features, their explanatory value is ultimately overrated. This book adopts a broader comparative perspective to understand the rise of the German Constitutional Court. It interprets the particular features of German constitutional jurisprudence and the Court's strength as a reconciliation of two different legal paradigms: first, a hierarchical legal culture as described by Mirjan Damaska, building on Max Weber, as opposed to a more co-ordinate understanding of legal authority such as prevails in the United States, and secondly, the turn towards a transformative understanding of constitutionalism, as it is today most often associated with countries such as South Africa and India. Using post-war legal history and sociological and empirical research in addition to case law, this book demonstrates how German constitutionalism has harmonized the frequently conflicting demands of these two legal paradigms, resulting in a distinctive type of constitutional reasoning, at once open, pragmatic, formalist, and technical, which this book labels Value Formalism. Value Formalism, however, also comes with serious drawbacks, such as a lack of institutional self-reflection in the Court's jurisprudence and a closure of constitutional discourse to laymen, whom it excludes from the realm of legitimate interpreters.

In den dreißiger Jahren des 19. Jahrhunderts stand eine Gruppe russischer Europäer mitten im intellektuellen und politischen Geschehen um die europäische Moderne. Michail Bakunin gehörte zu denjenigen, die die Gleichung Heinrich Heines „Große französische Revolution = Philosophie des deutschen Idealismus“ bejahten und im eigenen Leben vollziehen wollten. Die „faule Beschaulichkeit“ des preußischen Hegel war erkannt, gerade von seinen Anhängern wie z. B. Arnold Ruge. Die Studie von Sigrun Bielfeldt verfolgt den intellektuellen Weg Michail Bakunins von 1835 bis 1842. In Moskau war er zunächst Verfechter des politisch genehmen Rechtshegelianismus. Schließlich wurde er 1842 in Berlin vorübergehend zum Anhänger Schellings, bevor er sich endgültig von der Philosophie abwandte. Seine existenziellen Revolutionen zeigen sich von der latent revolutionären Philosophie Schellings beeinflußt. Der Berliner Schelling und sein Hörer Michail Bakunin suchten beide den Weg ins Offene.

1797 erscheint mit den Metaphysischen Anfangsgründen der Rechtslehre Immanuel Kants rechtsphilosophisches Hauptwerk. Nicht selten begegnet man daher der Auffassung, Kants Rechtsphilosophie entstamme im Wesentlichen seiner Spätphase und sei überdies nur schwer mit der kritischen Moralphilosophie der 1780er Jahre in Einklang zu bringen. Vor diesem Hintergrund widmet sich die vorliegende Untersuchung dem Vergleich des kantischen Rechtsbegriffs, wie er 1797 in der Einleitung in die Rechtslehre vorgestellt wird, mit Kants Ausführungen in den Vorlesungsnachschriften Moral-Mrongovius II und Naturrecht-Feyerabend aus dem Jahre 1784. Dabei kann nachgewiesen werden, dass der Rechtsbegriff von 1797 bereits 1784 ausgearbeitet war. Mehr noch: Es zeigt sich, dass Kants Rechtsbegriff nicht nur bereits in der Phase seiner kritischen Moralphilosophie vorlag, sondern vielmehr in einem Guss mit ihr konzipiert wurde und wie diese auf dem kritischen Freiheitsbegriff basiert.

This volume collects thirteen original essays that address the concept of will in Classical German Philosophy from Kant to Schopenhauer. During this short, but prolific period, the concept of will underwent various transformations. While Kant identifies the will with pure practical reason, Fichte introduces, in the wake of Reinhold, an originally biological concept of drive into his ethical theory, thereby expanding on the Kantian notion of the will. Schelling, Hegel, and Schopenhauer take a step further and conceive the will either as a primal being (Schelling), as a socio-ontological entity (Hegel), or as a blindly striving, non-rational force (Schopenhauer). Thus, the history of the will is marked by a complex set of tensions between rational and non-rational aspects of practical volition. The book outlines these transformations from a historical and systematic point of view. It offers an overview of the most important theories of the will by the major figures of Classical German Philosophy, but also includes interpretations of conceptions developed by lesser-studied philosophers such as Maimon, Jacobi, Reinhold, and Bouterwek.
