Indonesia has transformed from one of South East Asia’s most repressive and centralised political systems to its most decentralised and democratic. Despite this, obstacles still remain that hinder Indonesia achieving the ‘rule of law’, and in particular, the country is consistently ranked as having one of the highest levels of corruption in the world. This book assesses Indonesia’s anti-corruption reforms over the past decade, focusing on the Anti-corruption Commission (KPK) and the Anti-corruption Court (ACC). The book discusses how both institutions have been largely successful since they began operating on 2004. Before 2008, the KPK and ACC largely focused on mid-senior level targets and faced resistance primarily in the form of constitutional challenges to their jurisdictions and powers. From 2008, however, the KPK began targeting politically-powerful figures, drawing resistance that now threatens the future efficacy of both institutions. It is largely in Indonesia’s courtrooms and lawmaking institutions that key battles between reformists and those preferring the status quo have played out. This book describes and analyses these judicial processes and legal changes. It shows that despite persistent claims that Indonesia’s legal system is dysfunctional, law is far from irrelevant in modern day Indonesia. The book is a useful contribution to South East Asian politics and Asian law.

Buku yang ada di hadapan sidang pembaca ini awalnya adalah kajian yang disiapkan atas permintaan Indonesia Corruption Watch. Menyambut masa kerja Komisi Pemberantasan Korupsi (KPK) yang ke-12, ICW meminta sayamelakukan evaluasi atas keberadaan dan kinerja KPK. Evaluasi dilakukan dari sisi pandang hukum tata negara, bidang yang selama ini saya pelajari. Tentu permintaan dari lembaga sekelas ICW, yang telah diakui kredibilitas dan kapasitasnya tidak hanya secara nasional tetapi juga internasional terakhir di tahun 2015, ICWdinominasikan untuk meraih penghargaanAllard Prize for International Integrity adalah suatu kehormatan bagi saya. Meskipun dimaksudkan hanya menjadi bahan kajian yang ringkas, saya menganggap evaluasi KPK tersebut terlalu penting untuk disajikan “seadanya”. Maka, meskipun diberikan waktu hanya dua minggu, penulis memutuskan untuk melakukan kajian yang lebih serius, dan akhirnya menghasilkan tulisan 135 halaman, dengan judul “Memperkuat Desain Kelembagaan KPK”, tentu masih dengan sisi pandang hukum tata negara. Meskipun sudah jauh dari rencana awal, yang hanya merupakan kajian singkat, saya memandang perlu untuk memperbaiki kajian untuk ICW itu, dan menyajikan dalam bentuk yang lebih lengkap, dan akhirnya dibukukan. Maka, hadirlah buku ini. Momentum penerbitannya yang tepat, di tengahtengah rencana revisi Undang-Undang KPK, diharapkan dapat memberikan masukan yang lebih akademik, di samping praktik, atas eksistensi KPK. Terakhir, dalam konsultasi antara Presiden dan DPR, disepakati bahwa RUU Perubahan UU KPK akan ditunda pembahasannya, namun tidak dihentikan. Sosialisasi dan diskusi dengan masyarakat luas akan terlebih dahulu dilakukan, sebelum rencana revisi dilanjutkan. Maka, buku dengan berbagai argumen bagaimana sebaiknya penguatan KPK dilakukan ini, menjadi makin relevan untuk hadir. Harapannya, buku ini bisa menjadi salah satu rujukan panduan agar KPK sebagaimana disepakati bahkan oleh kelompok yang mendukung revisi UU KPK, makin menguat, bukan malah dilemahkan, atau bahkan dimatikan.
