Der wesentliche Inhalt dieses Buchs liegt in der Beantwortung der Fragen: ‘Bietet die ökonomische Kriminalitätstheorie mit dem Rational-Choice-Ansatz ein sinnvolles Handlungskonzept zur Erklärung kriminellen Verhaltens? Und bietet die Theorie nach Becker die versprochene Lösung für das Handlungsdilemma der soziologischen Theorien?’, und der Untersuchung der These: ‘Wenn kriminelle Handlungen auf Grundlage rationaler Wahlentscheidungen getroffen werden, dann sollte eine Erhöhung/Verringerung des Strafmaßes den Nettonutzen einer Tat senken/erhöhen und so zu einer Verringerung/Steigerung von Kriminalität führen.’. Nach einer Einführung der wichtigsten Begrifflichkeiten erfolgt eine kurze, schematische Darstellung ausgesuchter Kriminalitätstheorien und ihrer Abgrenzung zu einander. Es folgt eine Darlegung der Schwächen sozialwissenschaftlicher Theorien zur Erklärung delinquenten Verhaltens und der Implementierung der Rational-Choice-Theorie nach Becker als eine mögliche Lösung. Im weiteren Verlauf wird zusätzlich zum Grundmodell die Unterscheidung der Faktoren Risiko und Unsicherheit und ihre potentiellen Auswirkungen auf die Erklärung kriminellen Verhaltens untersucht. Nach einer kritischen Auseinandersetzung bezüglich der theoretischen Aussagekraft und Berücksichtigung empirischer Untersuchungen nach Entorf und Spengler sowie Kerner, Eikens und Hartmann, beschließt der Autor diese Arbeit mit einem persönlichen Fazit.

In der vorliegenden Studie wird durch einen Rückgriff auf allgemeine soziologische Theorien eine allgemeine Kriminalitätstheorie konzipiert, in der die genannten Fragestellungen berücksichtigt werden. Von Alessandro Baratta Die vorliegende Arbeit stellt einen Teil der Auswertung von Ergebnissen aus dem Forschungs projekt "Soziale Reaktion auf abweichendes Verhalten mit besonderer Berucksichtigung des nicht-institutionellen Bereiches" (DFG Ba 543) dar. Dieses Projekt wurde von der Deutschen Forschungsgemeinschaft im Rahmen des Schwerpunktes "Empirische Sanktionsforschung" fur die Dauer von zweieinhalb Jahren, von Juni 1974 bis Dezember 1976, finanziert und am Institut fur Rechts- und Sozialphilosophie der Universitat des Saarlandes durchgefuhrt. Der Antrag bei der DFG wurde von der Autorin, von mir und von Professor Dr. Fritz Sack (TU Hannover) ge stellt. 1m Rahmen dieses Forschungsprojektes wurden zwei empirische Erhebungen durchgefuhrt: eine reprasentative Befragung von ca. 2.000 Burgern der Bundesrepublik Deutschland und West Berlins und eine reprasentative Befragung von ca. 300 Strafrichtern desselben Einzugsgebietes. Intimate image abuse is a recent, endemic phenomenon which raises multiple legal issues and presents a significant challenge for the traditional institutions of law and criminal justice. The nature of this phenomenon requires considering the traditional complexities of regulating privacy, sexual offences, and cybercrimes, alongside the social and cultural issue of what may be considered 'intimate', 'private', or indeed 'sexual'. Since the harm experienced by victims of intimate image abuse is particularly serious and involves disparate legal interests, criminal law has been invoked as one of the solutions, but it is unclear what its role and limits should be. The law's approach should avoid any moralistic attitude, trying to achieve a balance between sexual autonomy and the protection of sexual privacy. At the same time, the needs of criminalization must be balanced with the traditional principles of criminal law. Criminalizing Intimate Image Abuse strives primarily to generate new conceptual and theoretical frameworks to address the legal responses to this phenomenon, by bringing together a number of scholars involved in the study of intimate image abuse over recent years. This volume compares the solutions developed in different legal systems. The perspective is mainly focused on the comparison between the Anglo-American criminalization model and that of continental Europe, but there are also overviews of the criminalization trends in Asian and Latin American countries. Once the criminalization of intimate image abuse, as well as its theoretical and practical limits, have been established, the analysis focuses on possible new legal strategies, complementary or alternative to traditional criminal justice, such as restorative justice. Finally, in order to achieve an effective safeguard for victim-survivors, the book deals with the role of Internet Service Providers and bystanders in preventing intimate image abuse.
