Zur Charakterisierung der Politik im deutschen Bundesstaat werden seit Ende der 1960er Jahre vor allem zwei Begriffe verwendet, die die Entwicklungstendenzen des bundesstaatlichen Ordnungsprinzips am ehesten beschreiben: Politikverflechtung und F”deralismus. Im Rahmen der Koordination und Kooperation der verschiedenen staatlichen Akteure ist ein komplexes Netzwerk von sich berschneidenden Zust„ndigkeiten, Koordinationsmustern sowie formellen und informellen Mitsprachebefugnissen entstanden. Vor dem Hintergrund des voranschreitenden europ„ischen Integrationsprozesses stellt sich fr die bundesdeutschen L„nder die Frage, wie sie auf die Europapolitik des Bundes und auf die politischen Entscheidungen, die auf europ„ischer Ebene getroffen werden, Einfluss nehmen k”nnen. Im Mittelpunkt steht dabei stets die Intention, den durch den europ„ischen Integrationsprozess erlittenen Kompetenzverlust auszugleichen und m”glichst das Heft des Handelns in der Hand zu behalten. Trotz ihrer Bemhungen mssen die L„nder eine wachsende Limitierung ihres eigenst„ndigen Handlungs- und Gestaltungsspielraums hinnehmen, wobei die Landesparlamente in besonderer Weise betroffen sind. Der Umstand, dass der bundesdeutsche F”deralismus das zwischen Nationalstaat und Europ„ischer Union bestehende Zwei-Ebenen-System um eine dritte subnationale Ebene erweitert, und die Frage, welche Konsequenzen dies fr die Beteiligungsm”glichkeiten der L„nder am europ„ischen Entscheidungsprozess hat, liegen dieser Arbeit zugrunde.

Federalism: The Canadian Experience offers readers an insight into a fascinating form of federalism. The founding fathers of the Canadian Federation attempted to draft a constitution that would ensure a centralized structure with a weak senate and limited power for the provinces. However, over time the process of decision making became more decentralized (in contrast to the USA and Australia for example, where it became more centralized) because of the pressure of sociopolitical and economic realities. The role of French-speaking Quebec in the development of Canadian federalism can hardly be overestimated. Various efforts have been made to accommodate the demands of Quebec for recognition as a "distinct society", but little has been done thus far to restructure the constitution on a grand scale. The ethic interaction, the demands of the indigenous people, the Charter of Rights and Freedom, intergovernmental relations and the asymmetry between the provinces are all matters that require further analysis and discussion.

Federalism has played a central role in charting educational progress in many countries. With an evolving balance between centralization and decentralization, federalism is designed to promote accountability standards without tempering regional and local preferences. Federalism facilitates negotiations both vertically between the central authority and local entities as well as horizontally among diverse interests. Innovative educational practices are often validated by a few local entities prior to scaling up to the national level. Because of the division of revenue sources between central authority and decentralized entities, federalism encourages a certain degree of fiscal competition at the local and regional level. The balance of centralization and decentralization also varies across institutional and policy domains, such as the legislative framework for education, drafting of curricula, benchmarking for accountability, accreditation, teacher training, and administrative responsibilities at the primary, secondary, and tertiary levels. Given these critical issues in federalism and education, this volume examines ongoing challenges and policy strategies in ten countries, namely Australia, Austria, Belgium, Canada, Germany, Italy, Spain, Switzerland, United Kingdom, and the United States. These chapters and the introductory overview aim to examine how countries with federal systems of government design, govern, finance, and assure quality in their educational systems spanning from early childhood to secondary school graduation. Particular attention is given to functional division between governmental layers of the federal system as well as mechanisms of intergovernmental cooperation both vertically and horizontally. The chapters aim to draw out comparative lessons and experiences in an area of great importance to not only federal countries but also countries that are emerging toward a federal system.

English summary: A multilevel government has taken the place of a nation state, which means that new questions pertaining to legal policy challenges and issues of legal dogmatics have arisen. One of the key questions in a multilevel system is the allocation of duties among the various levels. Birgit Schmidt am Busch studies whether not it is possible to find criteria which enable a systematic allocation of duties to each of the government levels. In order to illustrate this, she refers to the complex and highly topical subject of protecting health. In dealing with the four basic tasks of protecting health - prevention, cure, rehab, care for the terminally ill - she gives a detailed description of the structure and function of the European multilevel system. In doing so, she focuses on the so-called third sector, i.e. those institutions which are in between the state and the market. German description: An die Stelle des Nationalstaats ist ein 'multi level government' getreten. Damit stellen sich neue rechtspolitische Herausforderungen und rechtsdogmatische Fragen. Eine Schlusselfrage im Mehrebenensystem ist die Verteilung der Aufgaben zwischen den Ebenen. Birgit Schmidt am Busch untersucht, ob sich Kriterien finden, die eine systematische Aufgabenzuordnung zu den jeweiligen staatlichen Ebenen ermoglichen. Als Referenzgebiet dient ihr dabei der hoch aktuelle, komplexe Bereich der Gesundheitssicherung. Am Beispiel der vier Grundaufgaben der Gesundheitssicherung - Pravention, Kuration, Rehabilitation, Sterbebegleitung - stellt sie unter eingehender Analyse Struktur und Funktion des europaischen Mehrebenensystems dar. Ihr Augenmerk richtet sie dabei auch auf den sogenannten Dritten Sektor, d.h. auf die zwischen Staat und Markt angesiedelten Institutionen. Die Autorin zeigt, dass sich die Aufgaben der Gesundheitssicherung auf zwei Aufgabentypen zuruckfuhren lassen: Sie sind entweder produktbezogen, d.h. zielen auf die Eindammung der von einem Produkt ausgehenden Gefahrenquellen fur die menschliche Gesundheit (Lebensmittel), oder verhaltnisbezogen, d.h. zielen auf die Bekampfung der vom Menschen selbst ausgehenden Gefahren (Epidemien). Die Aufgabenverteilung im Mehrebenensystem hangt entscheidend davon ab, ob es sich um eine reine Wirtschaftsgemeinschaft handelt oder um ein integratives System. Die produktbezogenen Aufgaben werden in der Regel zentral wahrgenommen. In integrativen Systemen werden daruber hinaus auch die verhaltnisbezogenen Aufgaben von der zentralen Ebene koordiniert, um einheitliche Lebensverhaltnisse zu erzielen.

Diese Arbeit soll jedoch zeigen, dass nicht die territoriale Aufteilung eines Staates entscheidend ist für eine föderale Staatsform, sondern vielmehr ein föderales Denken und eine föderale Kultur, neben dem notwendigen rechtlichen Rahmen. Italiens Suche nach dieser föderalen Kultur, seine Bestrebungen, die politische Macht zu dezentralisieren, stehen denn auch im Zentrum dieser Arbeit. Sie zeigt auf, warum sich Italien trotz guten, rechtlichen Voraussetzungen nach wie vor schwer tut mit dieser föderalen Kultur, warum es dem Stiefel Europas auch nach dem Zusammenbruch der ersten Republik nicht gelungen ist, seine Staatsstruktur grundlegend und nachhaltig zu reformieren.
