Discussions of the possibility to attribute liability to legal persons for committing offenses are far from new. The EU landscape however is scattered. Although there are obligations for the Member States to introduce liability for legal persons committing offenses, diversity remains as to: the offenses that may trigger liability * the legal persons that may be held liable * the attribution theories and mechanisms used * the type of liability, which may be either penal, administrative, or civil * the sanctions that legal persons may incur. Consistent policy making requires an identification of the main commonalities and differences in view of being able to adequately reflect them in cross-national policy initiatives. Hence, the European Commission launched a call for tender for a study on the issue, which was awarded to the Institute for International Research on Criminal Policy (IRCP). The results are published in this book. Based on comparative legal analysis in the EU27, recommendations are formulated relating to the EU approximation policy (amongst others to reconsider the concept of a 'legal person' and to look into the need for specific 'legal person'-offenses), the functioning of mutual recognition (amongst others to extend the current mutual recognition instrumentarium), the exchange of information (amongst others to develop a criminal records policy), and procedural safeguards (amongst others to secure equivalent protection outside a criminal liability context). This book presents a critical view of international law as an argumentative practice that aims to 'depoliticise' international relations. Drawing from a range of materials, Koskenniemi demonstrates how international law becomes vulnerable to the contrasting criticisms of being either an irrelevant moralist Utopia or a manipulable façade for State interests. He examines the conflicts inherent in international law - sources, sovereignty, 'custom' and 'world order' - and shows how legal discourse about such subjects can be described in terms of a small number of argumentative rules. This book was originally published in English in Finland in 1989 and though it quickly became a classic, it has been out of print for some years. In 2006, Cambridge was proud to reissue this seminal text, together with a freshly written Epilogue in which the author both responds to critiques of the original work, and reflects on the effect and significance of his 'deconstructive' approach today.

This publication reports on the results of a coordinated research project on advances in high temperature gas cooled reactor (HTGR) fuel technology and describes the findings of research activities on coated particle developments. These comprise two specific benchmark exercises with the application of HTGR fuel performance and fission product release codes, which helped compare the quality and validity of the computer models against experimental data. The project participants also examined techniques for fuel characterization and advanced quality assessment/quality control. The key exercise included a round-robin experimental study on the measurements of fuel kernel and particle coating properties of recent Korean, South African and US coated particle productions applying the respective qualification measures of each participating Member State. The summary report documents the results and conclusions achieved by the project and underlines the added value to contemporary knowledge on HTGR fuel.

This is the third volume of Models of the History of Philosophy, a collaborative work on the history of the history of philosophy dating from the Renaissance to the end of the nineteenth century. The volume covers a decisive period in the history of modern thought, from Voltaire and the great “Encyclopédie” of Diderot and d'Alembert to the age of Kant, i.e. from the histoire de l'esprit humain animated by the idea of progress to the a priori history of human thought. The interest of the philosophes and the Kantians (Buhle and Tennemann) in the study and the reconstruction of the philosophies of the past was characterized by a spirit that was highly critical, but at the same time systematic. In the 1950s, civic society in South Africa became mobilized against racist laws that penetrated nearly every aspect of civic life. The social justice struggle that eventually displaced white minority rule culminated in democratic elections in 1994. Following this historic transition from authoritarian rule to democracy, other issues came to the fore, including how the government was to receive persons claiming refugee status on the basis of persecution and war. Civic actors in South Africa again became mobilized around these 'new' human rights and social justice issues. At different moments, civic actors became engaged either in working with the government to develop a refugee policy, or in confronting the government to fulfill its national and international obligations towards refugees. This book discusses the dynamics of civic-state interactions aimed at the state's obligations to promote, protect, and fulfill human rights. Through the lens of refugee rights advocacy in South Africa, in the first decade of its post-1994 period of democracy, this book examines and explains the circumstances under which civic-state interactions can lead to structural change, and what these interactions can teach us about the potential of civic society to realize rights in general.
