Les personnes de nationalité étrangère condamnées pour une infraction pénale peuvent être renvoyées du territoire suisse en vertu d'une décision de l'autorité compétente en matière migratoire ou d'une expulsion prononcée par le juge pénal. De telles mesures peuvent se heurter aux droits fondamentaux des personnes concernées ou des membres de leurs familles, qui subissent par ricochet des atteintes à leurs propres intérêts. La présente étude examine dans sa première partie l'étendue du régime de l'éloignement et la conformité de celui-ci au droit constitutionnel et international (s'agissant notamment du renvoi d'étrangers de la deuxième génération et d'enfants de nationalité suisse, des différences de traitement à l'égard des ressortissants nationaux ou entre étrangers européens et originaires d'États tiers, etc). Dans sa deuxième partie, l'auteure analyse en profondeur la pesée des intérêts requise lors des décisions concrètes et formule des propositions d'améliorations à cet égard. Les développements se fondent sur de nombreux arrêts du Tribunal fédéral et de la Cour européenne des droits de l'homme. L'étude constitue ainsi un outil précieux pour les praticiens en droit pénal et en droit des personnes étrangères.

This volume examines the implementation of the Return Directive from the perspective of judicial dialogue. While the role of judges has been widely addressed in European asylum law and EU law more generally, their role in EU return policy has hitherto remained under explored. This volume addresses the interaction and dialogue between domestic judiciaries and European courts in the implementation of European return policy. This book offers a unique comparative assessment of the evolution of immigration detention systems in European Union member states since the onset of the “refugee crisis.” By applying an analytical framework premised on international human rights law in assessing domestic detention regimes, the book reveals the extent to which EU legislation has led to the adoption of laws and practices that may disregard fundamental rights and standards. While emphasizing policies and laws adopted in response to the “refugee crisis,” the volume also shows how these policies have evolved—and in many cases grown more restrictive—even as the “crisis” has begun to recede from the borders of many European countries. To sharpen awareness of contrasting developments across the region, the book’s country chapters are organised into geographic sections that reveal how variations in migration pressures have in some cases resulted in contrasting detention practices even as the EU directives have sought to harmonise immigration laws. This book is about Raymond Federman and his incredible textual obsession with Samuel Beckett. Federman was a scholar of Beckett, postmodern theorist, a self-translator and avant-garde novelist. Born in Paris in 1928, all of his immediate family perished in the Holocaust. Federman escaped thanks to his mother, who hid him in a closet. After the war, he migrated to America and devoted his life to scholarship and creative writing. In both, he devoted his life to Beckett. Federman’s creative and theoretical writings contaminate and pervert each other just as, in his novels, French contaminates English and fiction perverts reality. His work is centered on the details of his survival, enacting a perpetual return to the closet, as previous studies have demonstrated. By examining Beckettian (and by extension Joycean) intertextuality in the novels of Raymond Federman, this study traces the contours of a second closet.
