This book traces the evolution of crimes against humanity (CAH) and their application from the end of World War I to the present day, in terms of both historic legal analysis and subject-matter content. The first part of the book addresses general issues pertaining to the categorization of CAH in normative jurisprudential and doctrinal terms. This is followed by an analysis of the specific contents of CAH, describing its historic phases going through international criminal tribunals, mixed model tribunals and the International Criminal Court. The book examines the general parts and defenses of the crime, along with the history and jurisprudence of both international and national prosecutions. For the first time, a list of all countries that have enacted national legislation specifically directed at CAH is collected, along with all of the national prosecutions that have occurred under national legislation up to 2010.

This book explores the ambiguities of the French law of genocide by exposing the inexplicable dichotomy between a progressive theory and an overly conservative practice. Based on the observation that the crime of genocide has remained absent from French courtrooms to the benefit of crimes against humanity, this research dissects the reasons for this absence, reviewing and analysing the potential legal obstacles to the judicial use of the law of genocide before contemplating the definitional impact of this judicial reluctance and the consequent confusion between the two crimes. Whilst it uses the French law of genocide and related case law on crimes against humanity as its focal points, the book further adopts a more general standpoint, suggesting that the French misunderstandings of the crime of genocide might ultimately be symptomatic of a more widespread misconception of the crime of genocide as a crime perpetrated against 'a group'.

The Value Of Humanity written by L. Nandi Theunissen and has been published by Oxford University Press, USA this book supported file pdf, txt, epub, kindle and other format this book has been release on 2020-01-02 with Philosophy categories.

L. Nandi Theunissen develops a non-Kantian account of the value of human beings. Against the Kantian tradition, in which humanity is absolutely valuable and unlike the value of anything else, Theunissen outlines a relational proposal according to which our value is continuous with the value of other valuable things. She takes the Socratic starting point that good is affecting, and more particularly, that good is a notion of benefit. If people are bearers of value, the proposal is that our value is no exception. Theunissen explores the possibility that our value is explained through reciprocal relations, or relations of interdependence, as when--as daughters, or teachers, or friends--we benefit others by being part or constitutive of relationships with them. She also investigates the possibility that we can be said to stand in a valuable relationship with ourselves. Ultimately, in The Value of Humanity, she proposes that people are of value because we are constituted in such a way that we can be good for ourselves in the sense that we are able to lead flourishing lives. Intuitively, a person matters because she matters to herself in a very particular sort of way; to appropriate a phrase, she is a being for whom her life can be an issue.

This challenging volume contains articles by a wide variety of well-known scholars and practitioners, and deals with human rights, international humanitarian law, international criminal law and humanitarian assistance, as well as other areas of international law relating to the protection of humanity. These are topics to which Flavia Lattanzi, in whose honour the volume is being published, has made an outstanding contribution and to which she has given her determined and unrelenting professional and personal commitment. As a former Professor at the Universities of Pisa, Sassari, Teramo and Roma Tre and as Judge ad litem at the International Tribunal for Rwanda and the International Tribunal for the Former Yugoslavia, she has adhered constantly to a number of important principles, as reflected in the research contained in this volume. They include the firm conviction that respect for human rights is an indispensable precondition for durable peace; the notion that grave breaches of human rights, including the refusal to provide assistance to populations in distress, can imply a threat to international peace and security; and that guarantees against human rights violations include the question of the punishment of core crimes under International Law.

The circulation and entanglements of human beings, data, and goods have not necessarily and by themselves generated a universalising consciousness. The "global" and the "universal", in other words, are not the same. The idea of a world-society remains highly contested. Our times are marked by the fragmentation of a double relativistic character: the inevitable critique of Western universalism on the one hand, and resurgent identitarian and neo-nationalistic claims to identity on the other. Sources of an argumentation for a strong universalism brought forward by Western traditions such as Christianity, Marxism, and Liberalism have largely lost their legitimation. All the while, manifold and situated narratives of a common world that re-address the universal are under way of being produced and gain significance. This volume tracks the development and relevance of such cultural and social practices that posit forms of what we call minor universality. It asks: Where and how do contemporary practices open up concrete settings so as to create experiences, reflections and agencies of a shared humanity? To treat some human beings as less worthy of concern and respect than others is to lose sight of their humanity. But what does this moral blindness amount to? What are we missing when we fail to appreciate the value of humanity? The essays in this volume offer a wide range of competing, yet overlapping, answers to these questions. Some essays examine influential views in the history of Western philosophy. In others, philosophers currently working in ethics develop and defend their own views. Some essays appeal to distinctively human capacities. Others argue that our obligations to one another are ultimately grounded in self-interest, or certain shared interests, or our natural sociability. The philosophers featured here disagree about whether the value of human beings depends on the value of anything else. They disagree about how reason and rationality relate to this value, and even about whether we can reason our way to discovering it. This rich selection of proposals encourages us to rethink some of our own deepest assumptions about the moral significance of being human.
