La expresión estructural evoca aquello que es importante en relación con un andamiaje o construcción; en el caso del texto que aquí se presenta alude en efecto a materias que son esenciales en el proceso permanente y gradual de elaboración y realización del ideal regulativo de la Fuerza Pública en el marco de un Estado social y democrático de derecho. Bajo esta perspectiva, el lector encontrará que el Ejército de Colombia es una organización en permanente transformación, y que en el "abanico" de asuntos que provocan su interés destacan aquellos que generan tensiones relevantes en el cumplimiento de su misión constitucional. La primera parte de los escritos de este volumen, explora la razón de ser de los deberes que tiene el Estado relativos a la protección del medioambiente y, de forma inédita, se ocupa de las acciones concretas de protección que deben desplegar las Fuerzas Militares y hacer propuestas de uso específico de las funciones de conducción de la guerra en esta tarea. Igualmente, se aborda la pertinencia del principio de precaución para contribuir a evitar los daños ambientales, bajo el reconocimiento de la potencialidad dañina del accionar militar y, en consecuencia, del deber superior de reflexión, en cabeza de la Fuerza, al momento de preparación, planeación, ejecución y evaluación de las operaciones militares. Otra cuestión cardinal, y especialmente sensible en relación con la legitimidad de la Fuerza Pública, vista desde la perspectiva más tradicional del concepto, es la asociada al ejercicio de una de las funciones de conducción de la guerra: la inteligencia. En un momento en que aún están vigentes los titulares periodísticos que cuestionan el posible uso indebido de este tipo de capacidad estratégica, la institución militar ha propiciado el análisis reposado y estricto sobre los límites normativos con especial atención a su condición de medio para la garantía de los fines esenciales del Estado de libertad y de con-vivencia pacífica, al tiempo que se reconoce el importante riesgo que su uso desviado puede implicar para la vigencia de derechos fundamentales.

Es para mí un privilegio infrecuente y enorme que este libro sea accesible a una audiencia hispanohablante. El libro se presenta como una intervención social teórica en el ámbito del derecho internacional de las inversiones –un orden jurídico que moldea parte del tejido que materializa a la globalización económica–. El libro también brinda una crítica de las formas jurídicas que toma el pensamiento neoliberal. A la luz de estos dos objetivos, no parece haber una mejor audiencia para este libro que la latinoamericana. Es en las latitudes meridionales donde el derecho de las inversiones ha tenido su más profundo impacto y donde continúa moldeando (y limitando) la capacidad estatal de implementar políticas públicas. Poner a prueba estas limitaciones frente a los postulados de los más importantes teóricos sociales ayuda, creo, a agudizar nuestro entendimiento de este régimen. Uno solo puede concluir que el régimen no es mucho más que el puro uso de la fuerza del derecho para maniatar a los estados y a los ciudadanos del Sur global.

How do civilians control the military? In the wake of September 11, the renewed presence of national security in everyday life has made this question all the more pressing. In this book, Peter Feaver proposes an ambitious new theory that treats civil-military relations as a principal-agent relationship, with the civilian executive monitoring the actions of military agents, the armed servants of the nation-state. Military obedience is not automatic but depends on strategic calculations of whether civilians will catch and punish misbehavior. This model challenges Samuel Huntington's professionalism-based model of civil-military relations, and provides an innovative way of making sense of the U.S. Cold War and post-Cold War experience--especially the distinctively stormy civil-military relations of the Clinton era. In the decade after the Cold War ended, civilians and the military had a variety of run-ins over whether and how to use military force. These episodes, as interpreted by agency theory, contradict the conventional wisdom that civil-military relations matter only if there is risk of a coup. On the contrary, military professionalism does not by itself ensure unchallenged civilian authority. As Feaver argues, agency theory offers the best foundation for thinking about relations between military and civilian leaders, now and in the future.
