Il détermine les employeurs concernés, définit les modalités de calcul, d'investissement et d'utilisation de la participation, présente les organismes collecteurs et les services proposés, traite des règles spécifiques aux départements d'outre-mer, et propose une analyse par rapport à la Communauté européenne. Cette deuxième édition, refondue, prend en compte la législation et la jurisprudence récentes. Depuis 1953, cette loi a permis de loger six millions de personnes, et elle représentait 13 milliards de francs de ressources à long terme en 1992. 170 000 employeurs, qui totalisent environ 11,5 millions de salariés, y sont assujettis, et ils versent la majeure partie des fonds à 191 comités interprofessionnels du logement (CIL), dont le total des bilans représente 94 milliards de francs. Employeurs, salariés, organisations syndicales d'employeurs, de salariés et organismes de construction sont tous concernés par ce mode de financement du logement en France. The limited scope of participation in the making of EU law remains a continued source of controversy, featuring prominently in recent institutional and political developments that have been shaping the EU's constitutional framework - most intensely in the follow up of the Commission's White Paper on Governance. Yet little attention has been paid to participation rights as a means of ensuring the procedural protection of persons affected by EU regulation in its diverse forms. This is a dimension of the rule of law that has been largely ignored by EU legislative and judicial bodies. Not only the legislator, but also the Court of Justice and the Court of First Instance tend to adhere to excessively formal conceptions of participation rights that are premised on the right to be heard in individual procedures, as well as to a restrictive view regarding the relationships between the citizens and the administration. This book shows why, in the face of new regulatory developments, these conceptions are currently inadequate to ensure the legal protection of rights and interests affected by EU regulation. Combining a conceptual analysis with thorough empirical scrutiny, this book assesses the scope of participation rights in EU law against their rationales and underlying legal values. It makes a case for the extension of participation rights to new situations and new types of procedures, in particular those that would generally fall within the category of rulemaking. Participation and Substantiality in Thomas Aquinas presents a comprehensive and penetrating account of Aquinas' metaphysics of creation. Its main focus is the concept of participation of being. On the basis of a detailed textual analysis a philosophical interpretation is offered of the main concepts and arguments which underlie Thomas' theocentric understanding of reality. The central unifying theme of the book is the apparent tension between the notion of participation (central to the Platonic tradition) and that of substance (central to the Aristotelian tradition). The author argues that Aquinas is quite successful in bringing together in his metaphysics on the one hand the substantiality of finite beings and on the other hand their total dependency upon the divine being by way of participation. The author defends his interpretation in a critical discussion of the views on participation brought forward by well-known Aquinas scholars such as Geiger and Fabro.
