The societal web of life is underpinned by one concept - that of Self and Other - which emerged earlier in this century. The concept has received a new formulation within the field of the phenomenology of life and the human creative condition, finding a foothold, a point of reference that radiates novel, seminal insights. The self-individualisation of the human being, as revealed in the present collection, is existentially and vitally intertwined with that of the Other. Los puntos de partida en Jakobos; Análisis de los puntos de partida a través de las consecuencias dogmáticas; Consideraciones finales. El presente trabajo es el resultado de una investigación llevada a cabo en el Instituto de Filosofía del Derecho de la Universidad de Bonn, dirigido por el Prof. Dr. GÜNTHER JAKOBS, que fue desarrollada entre el semestre de invierno de 1991 e igual semestre de 1993, gracias a la generosidad de un estipendio concedido por la fundación Alexander von Humboldt. Según su plan originario, la investigación debía referirse al desistimiento de la tentativa, con la pretensión de agotar toda su problemática. En el centro de las preocupaciones del autor se hallaba únicamente, sin embargo, la necesidad de superar una importante incongruencia habida en una investigación anterior 1, en la cual, si bien fue presentada una teoría de la imputación libre de la magia causal del disvalor de resultado, se había seguido rindiendo culto a la impunidad por desistimiento posterior a una tentativa acabada, bajo la condición de que el arrepentimiento activo fuera exitoso. El reducir el desistimiento a un problema atinente a la necesidad de pena y, por ende, ajeno a las razones que apoyaban la exclusión del disvalor de resultado del ámbito del ilícito2 , no era una respuesta concluyente; más bien ocultaba el dato de no haber sido hallado aún el camino para una solución armoniosa.
