Il est né de constatations faites au cours d'études approfondies sur la théorie des actes d'administration en actes d'autorité et en actes de gestion; on s'est aperçu aussi que si la jurisprudence accorde des indemnités pour les préjudices causés dans la gestion administrative, elle refuse d'en allouer pour ceux qui sont la conséquence d'actes d'autorité ; de là on a conclu qu'il existe deux modes d'activité de l'administration, l'un qui est la voie d'autorité, l'autre qui est la voie de gestion. Distinction d'autant plus intéressante que le contentieux de l'annulation semble attaché aux actes d'autorité, tandis que celui de la pleine juridiction serait réservé aux actes et aux situations de gestion. Mais il y a eu jusqu'ici plutôt une tendance instinctive de la jurisprudence et de la doctrine à créer une catégorie de la gestion, qu'un effort raisonné pour en organiser la théorie.
