The governance of education in many countries and regions of the world is currently in transition, challenging histories, remaking subjectivities and shaping possible futures. This book provides an up to date analysis and discussion of the cutting edge theme of educational governance from an international comparative perspective. The volume explores the landscape of educational governance in its broadest sense; considering new forms of steering, leadership and management, assessment and evaluation, teaching and learning, knowledge creation and the realities and possibilities for different forms of political engagement. The new spatial dynamics of education are explored in institutional settings such as schools and universities and via professional groupings such as teachers, administrators and leaders. The chapters in this book are based on the best peer reviewed papers and keynote speeches, which were delivered at the XXVI Conference of the Comparative Education Society in Europe (CESE) in June 2014 in Freiburg, Germany. The increasing trend and prevalence of incivilities-targeting punitive regulatory measures across Europe raises important issues regarding the legitimacy, effectiveness and impact of such formal social control. Regulation and Social Control of Incivilities addresses the pertinent issues of current punitive regulation and the social control of incivilities, their trends, criminological explanations, political, spatial, cultural, representational and policing dimensions as well as the underlying behaviour it targets. Part I explores issues surrounding the regulation of incivilities, drawing examples from several European countries including Spain, Italy, Great Britain, Belgium, Slovenia and Hungary. It inspects the legal form and content of the prohibition of incivilities and the social factors that can help explain it, as well as the effectiveness and societal impact of various anti-nuisance measures. Part II focuses on social control and the representation of incivilities, including the construction and control of public nuisance in Belgium, the spatial and cultural aspects of incivilities and of law enforcement against them, the media representations of incivilities in the British and Flemish press, and the intersections between migration and control of incivilities when policing in the Netherlands. This book brings together international scholars to examine the ways in which understudied European countries approach the issue of anti-social behaviour. Un ouvrage richement documenté qui revient sur les manquements réglementaires d'avant-crise et l'urgence d'une plus grande transparence à l'égard des épargnants et des investisseurs. La gravité de la crise financière ne signifie pas que les cadres juridiques antérieurs fussent totalement exempts de « diligences régulatoires ». L’étude de ses causes laisse plutôt penser que la régulation du système financier était défaillante dans ses paramètres et son application. De ce point de vue, la crise peut être perçue comme une crise de la régulation. Or, le système financier appelle une régulation spécifique en raison des caractéristiques des marchés qui le composent (banque, finance, assurance), complexes, innovants, globaux et interconnectés, donc menacés du risque systémique. La question de la régulation bancaire et financière n’est pas récente. Elle a toutefois pris une ampleur nouvelle depuis la crise de septembre-octobre 2008, suivie peu de temps après par l’affaire Madoff et, en 2010-2011, par la crise de la dette souveraine. Ces événements ont affecté nombre de pays et ont conduit à revoir et à approfondir les règles applicables au secteur bancaire et financier, cela afin de préserver, dans un monde sans frontière, la sécurité et la stabilité des marchés, des acteurs et des États. Étant observé que l’on se demande si l’on est mieux protégé aujourd’hui qu’en 2008 : la réponse est controversée ! La sécurité est l’un des thèmes majeurs de la régulation, mais il n’est pas le seul : l’intégrité et la transparence en sont d’autres. On pourrait encore citer la protection des clients, les nouvelles technologies et le développement durable, thèmes qui montent, depuis plusieurs années, en puissance. L’émergence des crypto-actifs, la crise sanitaire de la Covid-19 (2020-2021) et le réchauffement climatique l’illustrent. Cela explique que la seule réponse nationale est insuffisante : une réponse européenne et internationale est indispensable. Les acteurs de l’encadrement européen et international sont peu connus. Aussi est-il important d’y consacrer des développements – sont notamment étudiés les autorités européennes de surveillance (AES), l’Union bancaire et les « différents G », tels que le G 20 – même si les réponses apportées par les autorités européennes et internationales constituent l’essentiel de l’ouvrage, celui-ci mettant en lumière tant les travaux du Comité de Bâle, de l’OICV, du GAFI et du FSB que les textes européens des niveaux 1 (Parlement européen et Conseil), 2 (Commission européenne) et 3 (AES).
