El presente libro fue elaborado por el grupo de investigación en Derecho Público y TIC, G-TICCY de la Universidad Católica de Colombia, como resultado del proyecto de investigación sobre la responsabilidad del Estado por la utilización de las administraciones públicas de las nuevas tecnologías de la información y la comunicación – TIC, atendiendo especialmente la promoción y respeto de los derechos fundamentales en general, la protección de los datos, las actuaciones administrativas respecto de los proveedores de servicios de telecomunicaciones, y la generación y difusión de contenidos en internet a través del gobierno en línea. Se ha pretendido en este libro, no solo plantear una serie de problemas todos ligados a la responsabilidad del Estado, sino analizar que estos explican diversos niveles de esta responsabilidad, difusa cuando el modelo de aplicación se refiere a asuntos típicos de marcos regulatorios generales y concreta cuando hace referencia directamente a derechos fundamentales.

Esta obra que llega ahora a su tercera edición- es un manual de consulta sobre la responsabilidad civil extracontractual del Estado con base en la abundante jurisprudencia, leyes y actos administrativos del Estado colombiano. Aquí se define y ejemplifica la responsabilidad del Estado en materia ambiental, médica estatal, legislativa y judicial; en eventos como actos terroristas, daños sufridos por los reclusos e impago de recompensas presidenciales; y para grupos como la fuerza pública y servidores públicos. En esta ocasión se hace énfasis en la llamada “constitucionalizacion” de la responsabilidad patrimonial del Estado, la incorporación del concepto de víctima en la jurisprudencia y los avances en responsabilidad médica obstétrica y por infecciones nosocomiales. Se destacan también los cambios en el sistema de perjuicios inmateriales y el reconocimiento de tres tipos de criterios (perjuicio moral, daños a bienes constitucionales y convencionales, y daño a la salud) en fallo del Consejo de Estado en 2014. Se destacan también los fallos más recientes sobre responsabilidad internacional del Estado colombiano, emitidos por la Corte Interamericana de Derechos Humanos: casos Manuel Cepeda Vargas, Masacre de Santo Domingo, comunidades afrodescendientes desplazadas de la cuenca del Río Cacarica (Operación Génesis), y Rodríguez Vera y otros (Desaparecidos del Palacio de Justicia).

Este estudio aborda la responsabilidad del Estado originada en el manejo de exenciones tributarias, teniendo como agente causante del daño al legislador, quien conforme al principio de legalidad del tributo, crea y modifica las exenciones tributarias.
