Harmonizing Europe analyzes factors that both drive and impede the establishment of transnational markets, such as the European Union (EU), NAFTA or MERCOSUR. The author argues that the fit between domestic institutions (namely, the legal and administrative legacies of nation states, and the organization of interest groups) and the rules and regulations of transnational markets determines the degree to which transnational markets find their way into member states and become reality. By turning to the EU and two of its directives (equal pay and air pollution), Duina explores the driving forces behind the implementation of such directives, the ability of institutional theory to explain political and social events, and the determining factors in the fate of environmental and gender policies in transnational markets.

Le but de cette thèse est d'étudier le travail des femmes dans l'entre-deux-guerres et notamment les mécanismes juridiques d'exclusion des femmes du marche du travail. La période est caractérisée par une très forte hostilité à l'égard de l'activité féminine, hostilité alimentée par la crise économique des années 30, le chômage et la dénatalité. La montée du fascisme et de l'extrême-droite en Europe participent également à ce mouvement de remise en cause du travail des femmes. dans une première partie, il s'agit de montrer que, malgré l'intégration économique des femmes favorisée par la taylorisation et la rationalisation de l'appareil productif, le droit au travail des femmes n'existe pas. Le droit civil et la politique familiale sont a l'origine d'une partie des restrictions de la liberté d'accès des femmes au marche du travail. La seconde partie comporte essentiellement une analyse des dispositions légales relatives aux conditions de travail. bien que le droit du travail s'oriente progressivement vers l'uniformisation des conditions de travail, il conserve et développe parallèlement un large champ dérogatoire qui ne vise que les femmes. Les discriminations à l'égard des femmes reposent sur la protection de la maternité et la préservation de la famille.
