This book investigates the role of law in confronting major societal transformations embodied by the emergence of nanotechnologies. Taking the case of the European Union, it explores who the key decision-makers in the regulation of nanotechnologies are and how they take decisions. The questions are explored through two distinct case studies: the food and chemicals sectors. The book charts an incremental retreat of the European Union to its executive powers, including 'soft law' measures such as agencies' guidelines or implementing measures. This, the author argues, results in the Union's fundamental democratic control mechanisms, the EU legislature and the Court of Justice of the EU, being circumvented. The book recommends several immediate proposals to reform EU risk regulation, advocating a greater reliance on the European Parliament and outlining measures to increase the transparency of guidance drafting by EU agencies. By re-examining the political thought of Max Weber, Carl Schmitt and Hans Kelsen, this book offers a reflection on the nature of modern democracy and the question of its legitimacy. Pedro T. Magalhães shows that present-day elitist, populist and pluralist accounts of democracy owe, in diverse and often complicated ways, an intellectual debt to the interwar era, German-speaking, scholarly and political controversies on the problem(s) of modern democracy. A discussion of Weber’s ambivalent diagnosis of modernity and his elitist views on democracy, as they were elaborated especially in the 1910s, sets the groundwork for the study. Against that backdrop, Schmitt’s interwar political thought is interpreted as a form of neo-authoritarian populism, whereas Kelsen evinces robust, though not entirely unproblematic, pluralist consequences. In the conclusion, the author draws on Claude Lefort’s concept of indeterminacy to sketch a potentially more fruitful way than can be gleaned from the interwar German discussions of conceiving the nexus between the elitist, populist and pluralist faces of modern democracy. "How do writers, marginalized by the authoritarian state in which they live, intervene in the political process? They cannot do so directly because they are not politicians. Other modes of engagement are possible, however. A writer may take up arms and become a revolutionary. Or, as Max Weber did, he may try to influence politics by playing the role of constitutional advisor, or by seeking to shape the dominant language in which his contemporaries think. Weber sought to reconstitute the political and social vocabulary of his day.Part I of Caesarism, Charisma and Fate examines a great writer's political passions and the linguistic creativity they generated. Specially, it is an analysis of the manner in which Weber reshaped the nineteenth century idea of ""Caesarism,"" a term traditionally associated with the authoritarian populism of Napoleon III and Bismarck, and transmuted it into a concept that was either neutral or positive. The coup de grace of this alchemy was to make Caesarism reappear as charisma. In that transformation, a highly contentious political concept, suffused with disapproval and anxiety, was naturalized into an ideal type of universal value-free sociology.Part II augments Weber's ideas for the modem age. A recurrent preoccupation of Weber's writings was human ""fate,"" a condition that evokes the pathos of choice, the political meaning of death, and the formation of national solidarity. Peter Baehr, marrying Weber and Durkheim, fashions a new concept, ""community of fate,"" for sociological theory. Communities of fate--such as the Warsaw Ghetto or Hong Kong dealing with the Severe Acute Respiratory Syndrome (SARS) crisis--are embattled social sites in which people face the prospect of collective death. They cohere because of an intense and broadly shared focus of attention on a common plight. Weber's work helps us grasp the nature of such communities, the mechanisms that produce them, and, not least, their dramatic consequences.
