Este libro ofrece a toda la comunidad científica laboralista, por vez primera, la traducción castellana de doce normas laborales alemanas (once leyes y un reglamento) reguladoras de los aspectos nucleares del Derecho del Trabajo en la propia Alemania. Se trata de una monografía de interés excepcional, por varias razones. En primer lugar, porque no existe nada parecido a ella en el panorama de nuestra literatura jurídica, tanto nacional como internacional. En segundo lugar, porque permite hacerse con una visión panorámica de todo el Derecho del Trabajo alemán legislado, al ir acompañada la traducción de normas de sus correspondientes comentarios contextualizadores, realizados por los autores con apoyo en un elenco cuidadosamente elegido de bibliografía científica laboralista, predominantemente publicada en Alemania. En tercer lugar, porque los autores ofrecen la posibilidad de contrastar la fiabilidad de la traducción por ellos realizada, como es lógico, mediante el recurso al sitio de Internet (de acceso gratuito), patrocinado por el Ministerio federal alemán de Justicia, donde constan publicadas en versión consolidada y vernácula original todas las normas laborales cuya traducción se ofrece aquí a la comunidad científica. Los propios autores, comprometidos desde hace tiempo en la Facultad de Derecho de la Universidad de A Coruña en la enseñanza del Derecho comparado del Trabajo y de la Seguridad Social, anuncian en este libro su propósito de realizar el próximo curso académico 2007-2008 una segunda monografía, complementaria de ésta, relativa a los grandes casos judiciales del Derecho del Trabajo alemán.

El endiosamiento de la libertad absoluta del hombre se presta para su esclavización ideológica y económica y para el consiguiente desconocimiento de la dignidad humana. El orden público nacional se estructura con fundamento en la iniciativa privada, en la autonomía de la voluntad y en la concepción individualista, factores que desequilibran el consenso de solidaridad. Esta situación generalizada y agobiante del desarrollo social agita el descontento del pueblo trabajador, que lucha para que el Estado cambie de actitud y expida normas jurídicas de amparo y protección. Contribuyen a este proceso de rectificación del acentuado desequilibrio las doctrinas sociales, las crisis cíclicas del capitalismo, los movimientos sindicales y las nuevas técnicas industriales y empresariales que van haciendo mella en las ambiciones de lucro utilitario. Desde finales del siglo xix los Estados empiezan a expedir leyes laborales y a entronizar principios humanitarios, que servirían para formalizar el derecho del trabajo de carácter universal, acogido en todas las legislaciones del mundo. El Estado es ahora intervencionista en la economía y en el desarrollo social, y garantista de los derechos laborales que se consolidan constitucional, legal y universalmente, tras superar los condicionamientos del interés privado y de afianzar intensamente los ideales de equidad y justicia social. El derecho laboral alcanza carácter universal de cientificidad jurídica, de eticidad social y económica, y eleva la concepción humana del trabajo a categoría de naturaleza existencial. Sin embargo, el intervencionismo de Estado entra en crisis cuando los principios éticos se debilitan, el orden económico se globaliza, la ciencia adquiere carácter absoluto, la técnica pretende resolverlo todo con criterio pragmático, la moral se supedita a la teoría relativista y se impone el cínico realismo. Ante estos avatares el derecho laboral se deprime un tanto por los embates de las nuevas fuerzas del capitalismo, que desprecia los valores humanos y la dignidad del trabajo y los sustituye por la libre competencia de los sujetos laborales y los principios de la economía liberal, que resurgen dominante.
