DA INTRODUÇÃO 1. Enquadramento do tema Escolhemos para este estudo o tema dos limites da renúncia a direitos fundamentais nas relações entre particulares. Em termos muito gerais, temos como objectivo determinar os limites dentro dos quais o titular de um direito fundamental pode validamente dele dispor, enfraquecendo a sua posição jurídica subjectiva perante outro ente privado. A problemática da renúncia a direitos fundamentais, seja na relação Estado/cidadãos, seja nas relações entre particulares, é um tema com uma grande actualidade, na medida em que contende com uma série de questões controvertidas que hoje se colocam e para as quais não existe (e provavelmente nunca existirá) uma única resposta. Serão ?casos difíceis?, por exemplo, as situações de renúncia ao direito à reserva sobre a intimidade da vida privada em reality shows3, a renúncia ao direito à integridade física através da castração química de autores de crimes sexuais4, do consentimento na participação em experiências médicas5 ou na doação de órgãos6, e a renúncia ao direito à vida nos casos de eutanásia7 ou quando se admitem disposições antecipadas da vontade8. Estes exemplos são recondutíveis à figura da renúncia e em todos eles se verifica a presença de um interesse do titular do direito fundamental em dispor desse direito de modo a tomar uma decisão que considera relevante para a conformação da sua própria existência.
