"This work will be very valuable for academic and public libraries supporting prelaw, law, social, and cultural studies. Summing Up: Highly recommended. Upper-level undergraduates through professionals/practitioners; general readers." —CHOICE There are two aspects of scholarship about the legal systems of our day that are especially salient—one being for the first time there is a fair amount of genuine research on legal systems, and two, that this research is increasingly global. As soon as you cross a jurisdictional line, even if it separates countries that are very similar, you enter a different legal system. It cannot be assumed that any particular rule, doctrine, or practice is the same in any two jurisdictions, regardless of how close these jurisdictions are, in terms of history and tradition. The Encyclopedia of Law and Society is the largest comprehensive and international treatment of the law and society field. With an Advisory Board of 62 members from 20 countries and six continents, the three volumes of this state-of-the-art resource represent interdisciplinary perspectives on law from sociology, criminology, cultural anthropology, political science, social psychology, and economics. By globalizing the Encyclopedia′s coverage, American and international law and society will be better understood within its historical and comparative context. Key Features: Includes more than 700 biographical entries that are historical, comparative, topical, thematic, and methodological Presents the rich diversity of European, Latin American, Asian, African, and Australasian developments for the first time in one place to reveal the truly holistic, interdisciplinary virtues of law and society Examines how and why legal systems grow and change, how and why they respond (or fail to respond) to their environment, how and why they impact the life of society, and how and why the life of society impacts in turn these legal systems With borders more porous than ever before, this Encyclopedia reflects the paradoxical reality of modern life, including legal life. This valuable resource aims to present research, along with the theories on which it is grounded, fairly and comprehensively and is a must-have for all academic libraries.

Definition In The Criminal Law written by Andrew Halpin and has been published by Bloomsbury Publishing this book supported file pdf, txt, epub, kindle and other format this book has been release on 2004-10-13 with Law categories.

In recent years,a number of key terms of the criminal law have seemed to defy definition. Scepticism over the possibility of defining basic concepts and identifying general principles has been voiced by both judges and academic commentators. This raises broad issues of theoretical interest, but also touches on such practical concerns as the efforts made by the Law Commission to reform the law as well as wider proposals for the codification of criminal law. Furthermore, the Human Rights Act incorporates a requirement of legality under Article 7 of the ECHR, whose scope is clearly connected to our understanding of how criminal offences are defined. This book undertakes an investigation of the role and scope of definition within the criminal law, set within a wider examination of the nature of legal materials and the diversity of perspectives on law. It offers a fascinating account of how the rules and principles found within legal materials provide opportunities for responding to, rather than merely following the law. In the light of this account, the book takes issue with some of the established views on the roles of judges and academics and, in a series of case studies concerning the definition of theft and changes to the definition of recklessness recently introduced by the House of Lords in R V G , explores the intimate connection between the use of legal materials and the practice of definition. More specific objectives of the book involve providing a more rigorous assessment of the serious challenge made by a 'criticial' perpective on the criminal law; challenging the conventional intellectual apparatus of the criminal law; demonstrating how general theoretical insights on the process of definition can assist with the practical problems of defining criminal offences; clarifying the uses of definition in the work of the judiciary and law reformers; and, determining realistic expectations for the principle of legality within the criminal law.

Hate Crimes written by Barbara Perry and has been published by Bloomsbury Publishing USA this book supported file pdf, txt, epub, kindle and other format this book has been release on 2009-03-05 with Social Science categories.

This book offers a comprehensive approach to understanding hate crime, its causes, consequences, prevention, and prosecution. Hate crimes continue to be a pervasive problem in the United States. The murder of Matthew Shepard, the lynching of James Byrd, the murderous rampage of Benjamin Smith, and anti-Muslim violence remind us that incidence of deadly bigotry is not only a recurring chapter in U.S. history, but also a part of our present-day world. Contrary to common belief, hate mongers who commit crimes are rarely members of the Ku Klux Klan or a skinhead group. In fact, fewer than 5 percent of identifiable offenders are members of organized hate groups. Yet rather than being an individual crime, hate crime represents an assault against all members of stigmatized and marginalized communities. To fully understand the phenomenon of hate crime and reduce its incidence, it is necessary to clearly define the term itself, to examine the victims and the offenders, and to evaluate the consequences and harms of hate crimes. This comprehensive five-volume set carefully addresses the disturbing variety and incidence of hate crimes, exposing their impacts on the broader realms of crime, punishment, individual communities, and society. The contributing authors and editors pay critical attention to cutting-edge topics such as online hate crimes, hate-based music, anti-Latino hostilities, Islamaphobia, hate crimes in the War on Terror, school-based anti-hate initiatives, and more. The final volume of Hate Crimes provides valuable food for thought on possible legislative, educational, social policy, or community organizational responses to the varied forms of hate crime.
