Le site d'éditeur Giuffrè indique : "Il volume affronta la tematica della stretta correlazione ed interdipendenza esistente tra l¿accezione sostanziale e l¿accezione strumentale del principio di falsificazione, inteso quest¿ultimo quale principio epistemologico che permea e caratterizza l¿intero fenomeno processuale. Ed invero, considerato che il processo è in primo luogo uno strumento di conoscenza, nella prima parte della trattazione si esamina sinteticamente l¿evoluzione del pensiero gnoseologico per evidenziare come il pensiero contemporaneo concepisca la conoscenza non già in termini di episteme bensì in termini relativi, ovvero come una conoscenza non certa ma altamente probabile e come tale caratterizzata da un margine di dubbio ineliminabile; in tale ottica il metodo conoscitivo deve essere caratterizzato e finalizzato non solo alla dimostrazione della tesi ritenuta vera ma anche e soprattutto alla falsificazione delle tesi alternative (c.d. principio di falsificazione di cui alla filosofia di Karl Popper). La prima parte della trattazione prosegue quindi con la verifica della ¿compatibilità¿ di tali argomentazioni di carattere epistemologico con la tematica propria della teoria generale del processo, evidenziando come in tale prospettiva il principio di falsificazione, se rettamente inteso ed applicato, fa si che il dubbio che inevitabilmente accompagna ogni forma di conoscenza umana, nell¿accertamento processuale possa essere confinato entro limiti epistemologicamente accettabili e tali da individuare correttamente il limite del c.d. ¿ragionevole dubbio¿. Nella seconda parte della trattazione, esaminando il principio di falsificazione nella prospettiva del diritto positivo si evidenzia come in tale ottica detto principio si estrinseca nella dimensione sostanziale e nella dimensione strumentale, intendendo con il primo termine la valutazione del materiale probatorio in termini di dimostrazione della tesi ritenuta vera e falsificazione della tesi alternativa, e con il secondo l¿acquisizione della prova tramite il principio del contraddittorio ed il principio della prova contraria (c.d. processo aperto); le due accezioni sono per l¿appunto strettamente connesse nel senso che se la conoscenza si estrinseca nella dimostrazione della tesi ritenuta vera e nella falsificazione della tesi alternativa, tale risultato lo si può raggiungere se, e solo se, si struttura lo strumento conoscitivo (processo) in maniera tale da garantire la falsificazione dei singoli elementi di prova che costituiscono il dato reale della conoscenza processuale. Quindi nella terza e nella quarta parte si passa in rassegna la disciplina di dettaglio di diritto positivo (anche con specifico riferimento alla CEDU) della dimensione strumentale e della dimensione sostanziale del principio di falsificazione così come regolamentato nel nostro codice di rito."
