Law and justice are studied in this book from the perspective of social and global history. The main focus of Workers Before the Tribunal is to overcome traditional binary oppositions between corporativist and contratualist models of labor relations, the former representing a view in which the working class would have more autonomy in struggling for better labor conditions, the latter meaning the protagonism of the State in promoting labor rights. Teixeira da Silva presents three main arguments. First, he shows that the Brazilian labor justice system created during the Getúlio Vargas dictatorship (1930-1945), although inspired by Mussolini's legal order in Italy, is very different from the Fascist Magistratura del Lavoro. Second, in his comparative analysis with other national cases, such as the United States, France, Germany and Australia, the author argues that there was a large circulation of ideas and practices, resulting in a more complex dynamic of appropriation of international ideas on labor rights and institutions in Brazil. Third, Teixeira da Silva demonstrates that litigation in labor courts was one strategy of the working-class movement in Brazil, together with strikes and other means of confrontation. Therefore, he questions historiographical and political approaches that see labor justice as a weak substitute for class action. The "jurisdictionalization" of labor relations became a constitutive element in the making of the Brazilian working class. The book is anchored in the research of hundreds of labor litigation cases during the dramatic months preceding the 1964 civil-military coup d’état that inaugurated a quarter century of dictatorial rule in Brazil.

In this richly detailed, sensitive ethnographic work, Sally Cole takes as her starting point the firsthand accounts of five differently situated Portuguese women, who describe their lives in a rural fishing community on the north coast of Portugal. Skillfully combining these life stories with cultural and economic analysis, Cole radically departs from the picture of women as sexual beings that prevails in the anthropological literature on Europe and the Mediterranean. Her very different strategy--a focus on women as workers--reflects the Portuguese women's own definition of themselves and allows them the strong, resonant voice that is the goal of both the new ethnography and feminist scholarship. From this new perspective, Cole proposes an important critique of the dominant paradigm of southern European gender relations as being embedded in the code of honor and shame. Covering the Salazar years, as well as the period since the 1974 Revolution, Cole shows that fisherwomen of the past enjoyed greater autonomy in work and social relations than do their daughters and granddaughters, who live in a context of increasing commoditization and industrialization. Central to this account is an examination of the changing structure and role of the household as economic production moved to the factory.

The twentieth century will surely be remembered as a period of remarkable calamity, vigorous intellectual activity, and striking technological progress. For the first time in history, the development of rapid forms of communication and transportation shrunk the effective size of the world so that many of its citizens were made aware of events occurring in far-distant locations and came to appreciate cultural differences more directly than was previously possible. Among the many trends and events for which the century may be remembered, however, one will surely be the ascendancy of science and scientific thinking. Given adequate resources and ample time, scientists have argued they will be able to reduce the mysteries of the universe, as well as the mysteries of life and death, to objectifiable processes and events. The editors of this book draw attention to the implicit and explicit images of childhood that various disciplines -- especially development psychology -- have constructed. These sometimes unspoken metaphors have enduring value in that they provide a means of drawing together, integrating, and interpreting otherwise disparate findings or conclusions. They also provide a ready means of conveying the fruits of scientific research to the people who constitute its primary consumers. The contributors strive to show that the images of childhood that each professional implicitly carries in her or his head vary across historical epochs, just as they vary across cultures and subcultures. Perhaps even more alarmingly, some of these images seem to reflect the politically correct ideology of particular times and places, at least as much as they represent the objective findings they purport to summarize. This volume's main objective is to unpackage cultural and historical variations in the conception of childhood in order to make clearer those which might be considered universal aspects of behavioral and psychological development and those which must be seen as temporary cultural constructions or images. The specific aims of this volume are to: * delineate images of childhood in diverse cultural, subcultural, and historical contexts; * illustrate how these images of childhood are manifested in popular proverbs as well as in distinct patterns of childrearing, broadly conceived to include aspects of parental behavior, childcare arrangements, education, indoctrination, and the assignment of responsibilities; * indicate how these images of childhood are manifest in the development and implementation of educational and social policies as well as in the legal status of children; * consider whether children are believed to have a privileged place in society and whether age-graded constraints limit their roles and participation in society; and * evaluate the extent to which cultural images affect the ways in which developmental processes are viewed or understood.
