L'Europe s'est engagée depuis plusieurs années dans un processus de fermeture des frontières et le refus des aspirants à la migration. Cette politique crée des ondes de choc à l'intérieur des sociétés qui produisent les migrations. Les expulsions régulières, réalisées souvent avec la coopération des polices du sud pour la surveillance des frontières, accroissent le volume d'une population acculée à vivre dans une clandestinité de plus en plus pénalisante. Cette situation touche actuellement un nombre conséquent de mineurs, souvent enfants des rues, confrontés à des situations familiales et sociales défavorables, qui glissent de port en port, de gare en gare, vers l'objectif d'une vie meilleure. Ces gamins migrants, ballotés par la vie, connaissent ainsi des errances longues et chaotiques. Ils sont appelés mineurs migrants non accompagnés. Afin de prendre en compte leur errance, l'Europe a tenté de mettre en forme une législation respectant les directives internes des pays d'accueil et les impératifs des droits de l'enfant. Les textes rassemblés ici sont le résultat d'une recherche portant sur l'Europe et le Maghreb, associant anthropologues, juristes, éducateurs, psychologues qui ont tenté de comprendre la vie de ces adolescents, et d'étudier l'impact des mesures et de la sollicitude dont ils font l'objet. Les auteurs les ont interrogés et regardés vivre de Safi à Casablanca, de Hannaba à Barcelone et Bologne, d'Alger à Marseille. Ils ont ainsi constaté l'émergence d'un nouveau nomadisme touchant des jeunes, parfois très jeunes en perdition dans leur propre pays, qui se heurtent à des règles internationales brisant leurs rêves d'un autre ailleurs. This book offers a unique comparative assessment of the evolution of immigration detention systems in European Union member states since the onset of the “refugee crisis.” By applying an analytical framework premised on international human rights law in assessing domestic detention regimes, the book reveals the extent to which EU legislation has led to the adoption of laws and practices that may disregard fundamental rights and standards. While emphasizing policies and laws adopted in response to the “refugee crisis,” the volume also shows how these policies have evolved—and in many cases grown more restrictive—even as the “crisis” has begun to recede from the borders of many European countries. To sharpen awareness of contrasting developments across the region, the book’s country chapters are organised into geographic sections that reveal how variations in migration pressures have in some cases resulted in contrasting detention practices even as the EU directives have sought to harmonise immigration laws. A critical focus of the book are the evolving domestic norms related to grounds for detention, length of detention, non-custodial "alternatives to detention," the treatment of children, and conditions of detention.
