- L’opera analizza in maniera sintetica ma esaustiva le novità legislative introdotte nel nostro ordinamento giuridico dalla c.d. “Riforma Cartabia” che hanno come principali obiettivi la deflazione del carico giudiziario e l’efficienza della giustizia. Il commentario, grazie al contributo di autori esperti della materia che operano quotidianamente nel mondo del diritto, tende ad illustrare, sul piano teorico pratico, tutte le modifiche apportate al codice penale, con particolare riferimento alle novità introdotte in materia di reati perseguibili a “querela”, di pene sostitutive e pene detentive brevi che mirano a deflazionare i ruoli attraverso l’estinzione anticipata del procedimento. L’opera esamina, anche, tutte le modifiche apportate al codice di procedura penale inerenti al regime delle notificazioni in forma telematica, processo in assenza, durata e termini delle indagini preliminari, udienza preliminare, riforma ai riti alternativi, udienza filtro per i procedimenti monocratici a citazione diretta finalizzata a vagliare la fondatezza dell’azione penale, regime delle impugnazioni che prevede l’inammissibilità dell’atto di appello per difetto di specificità dei motivi e del ricorso per cassazione nel caso in cui i motivi di ricorso non si confrontano compiutamente con la motivazione della sentenza impugnata. Una trattazione particolare è dedicata al nuovo istituto della giustizia riparativa -introdotto nel nostro ordinamento giudiziario proprio con la riforma oggetto di esame - che consente alla vittima, alla persona indicata come autore dell’offesa ed altri soggetti appartenenti alla comunità di partecipare liberamente, in modo consensuale, attivo e volontario, alla risoluzione delle conflittualità derivanti dal reato, con l’aiuto di un mediatore imparziale, adeguatamente formato nella composizione dei conflitti. L’opera si conclude con l’analisi delle neo introdotte pene sostitutive delle detenzioni brevi, nonchè con la riforma della riscossione delle sanzioni pecuniarie principali e sostitutive. E, infine, sono esaminate sinteticamente le successive novità legislative inerenti all’ergastolo ostativo ed ai rave-party apportate con il decreto di proroga emanato dal nuovo governo Meloni il 31 ottobre 2022 n. 162
