The increase of crime at the national, transnational, and international levels has heightened concern in the international community and generated greater interest in international criminal justice policy. Since the 1950s, the United Nations has been developing the Crime Prevention and Criminal Justice Programme, which was designed to respond to these concerns. But United Nations resources and support for the programme have been limited, notwithstanding the services and contributions of the Crime Prevention and Criminal Justice Branch. La base esencial de este libro se asienta en un estudio crítico y realista de la pena en el Estado social y democrático de Derecho. No se plantea como un análisis en el sentido más tradicional de aproximación al concepto, fundamento, necesidad o fines de aquella con la reproducción de las teorías más sobresalientes al respecto, sino que sitúa los citados parámetros sobre hipótesis de racionalidad democrática y social y de legitimidad material basada en la aplicación cierta de los principios que fundamentan dicha legitimidad desde la perspectiva constitucional, con el objetivo de valorar y evaluar el grado y nivel de eficiencia y eficacia que se ha de requerir a una institución tan limitadora o, incluso, anuladora de derechos fundamentales de los ciudadanos. Sobre tales planteamientos se profundiza en la auténtica realidad de la pena de prisión tanto en su manifestación normativa como en su concreta aplicación desde una dimensión relevantemente empírica que conduce a atender de igual modo al resto de las penas fijadas en el catálogo correspondiente del artículo 33 del Código Penal, como alternativas derivadas de la propia naturaleza de las penas, no tanto en su contenido conceptual como en el comparativo con la de prisión, y a las alternativas específicas, desde un enfoque instrumental prioritariamente con vocación estadística, penitenciaria, sociológica y criminológica. Se construye, de este modo, un sólido armazón científico, dogmático, legislativo y fundamentalmente práctico que sirve como auténtica propuesta político criminal propia del siglo XXI. En definitiva, el objetivo final es, sobre la recopilación, interpretación y evaluación de los datos e hipótesis que se han obtenido de la metodología utilizada, conseguir, sobre ellos, un diagnóstico completo de la efectiva incidencia del sistema de penas, con la amplitud mencionada, de sus carencias y debilidades actuales, para mostrar unas variables políticocriminales que superan las permanentes contradicciones de un expansionismo sin al parecer límites y un reduccionismo perdido, a veces, en versiones no totalmente aceptadas socialmente.
