La presente obra se configura como un trabajo panorámico sobre la mediación en su vertiente penal que, como indica el subtítulo, da respuesta a los principales interrogantes que despierta la inclusión de un mecanismo netamente autocompositivo en un sistema penal como el español, tradicionalmente marcado por los principios de legalidad y oficialidad, y, por tanto, poco permeable a la autonomía de la voluntad de las partes. Para ello ha partido de la incontestable realidad de la crisis del actual modelo penal, trazando su devenir desde su creación por los reformistas ilustrados hasta nuestros días. También se repasan los antecedentes históricos de los métodos colaborativos de justicia penal y se hace una descripción del movimiento, de origen anglosajón, conocido como justicia restaurativa, proponiendo la mediación penal como el mecanismo más adecuado a las peculiaridades de la cultura jurídica de la Europa continental. Asimismo se analiza el encaje de la mediación con los principios informadores de nuestro Derecho penal; esta obra no defiende un sistema de mediación penal ajeno al proceso oficial, sino que aboga por su integración en el mismo, como vía a seguir bajo la tutela de las autoridades públicas. De igual manera, se expone la regulación legal de la mediación penal a nivel internacional y se analiza la legislación proyectada en España. Por último, se describe la situación de la mediación penal en los Estados de nuestro entorno, así como de las experiencias piloto desarrolladas en nuestro suelo.

Restorative justice - as an innovative approach to crime and criminal justice - has been growing constantly over the past twenty years. Its practices seem to hold great promise for victims, offenders, local communities, and the criminal justice system. Research has been set up in many countries to assess and explore restorative justice processes and outcomes. In spite of many program evaluations showing positive results, risks have been identified as well. Moreover, critics have depicted research in the field of restorative justice as 'a mile wide but only an inch deep.' In response to the criticism, this book takes up the challenge to examine restorative justice research as it is undertaken in nine European countries during last twenty years. The book provides an overview of empirical research on victim-offender mediation and conferencing. Restorative justice aims to address the consequences of crime by encouraging victims and offenders to communicate and discuss the harm caused by the crime that has been committed. In the majority of cases, restorative justice is facilitated by direct and indirect dialogue between victims and offenders, but it also includes support networks and sometimes involves professionals such as police, lawyers, social workers or prosecutors and judges. In theory, the victim is a core participant in restorative justice and the restoration of the harm is a first concern. In practice, questions arise as to whether the victim is actively involved in the process, what restoration may entail, whether there is a risk of secondary victimisation and whether the victim is truly at the heart of the restorative response, or whether the offender remains the focal point of attention. Using a combination of victimological literature and empirical data from a European research project, this book considers the role and the position of the victim in restorative justice practices, focusing on legislative, organisational and institutional frameworks of victim-offender mediation and conferencing programmes at a national and local level, as well as the victims’ personal needs and experiences.
