The 2005 Avant-projet de réforme du droit des obligations et de la prescription, also dubbed the Avant-projet Catala, suggests the most far-reaching reform of the French Civil code since it came into force in 1804. It reviews central aspects of contract law, the law of delict and the law of unjustified enrichment. There is currently a very lively debate in France as to the merits or the demerits of both the particular draft provisions and the general idea of recodification as such. This volume is the first publication to introduce the reform proposals to an English speaking audience. It contains the official English translation of the text, and distinguished private lawyers from both England and France analyse and assess particularly interesting aspects of the substantive draft provisions in a comparative perspective. La formule « de plein droit » est récurrente en droit privé, tant sous la plume de la doctrine que dans la loi et la jurisprudence. Sa signification tient assurément de l’énigme, dès lors qu’elle n’a quasiment jamais fait l’objet de recherches, et sans doute du trésor caché, en ce que la doctrine la considère depuis longtemps comme étant étroitement liée à un régime juridique spécifique. Au premier abord, ces termes ne renvoient qu’à une expression dont le sens varie selon la situation à laquelle la formule est rattachée. Elle trouve néanmoins un dénominateur commun dans le fait de désigner un renforcement de l’efficacité du processus de réalisation des effets juridiques. Il y a plus : l’expression fait l’objet d’une conceptualisation latente dans la science juridique depuis plusieurs siècles, qui conduit à analyser les termes « de plein droit » comme une véritable notion juridique. En vertu de celle-ci, les mécanismes de plein droit sont automatiques et déploient leurs effets selon le mode de réalisation le plus efficace. Cette notion permet alors de dégager l’existence jusque-là implicite d’un régime de plein droit, applicable à certains mécanismes contractuels. Cependant, la mise en lumière des principes de ce régime démontre que le postulat de l’existence d’une efficacité de plein droit tient du mythe. Les principes découverts se révèlent en effet en décalage avec les réalités du droit positif. In fine, l’effet de plein droit s’analyse comme une image de la force du droit et non comme la pierre angulaire du régime de certains mécanismes, manifestant ainsi tant les excès du raisonnement conceptualiste que l’ampleur du phénomène d’assouplissement du droit.
