How and what to teach about religion is controversial in every country. The Routledge International Handbook of Religious Education is the first book to comprehensively address the range of ways that major countries around the world teach religion in public and private educational institutions. It discusses how three models in particular seem to dominate the landscape. Countries with strong cultural traditions focused on a majority religion tend to adopt an "identification model," where instruction is provided only in the tenets of the majority religion, often to the detriment of other religions and their adherents. Countries with traditions that differentiate church and state tend to adopt a "separation model," thus either offering instruction in a wide range of religions, or in some cases teaching very little about religion, intentionally leaving it to religious institutions and the home setting to provide religious instruction. Still other countries attempt "managed pluralism," in which neither one, nor many, but rather a limited handful of major religious traditions are taught. Inevitably, there are countries which do not fit any of these dominant models and the range of methods touched upon in this book will surprise even the most enlightened reader. Religious instruction by educational institutions in 53 countries and regions of the world are explored by experts native to each country. These chapters discuss: Legal parameters in terms of subjective versus objective instruction in religion Constitutional, statutory, social and political contexts to religious approaches Distinctions between the kinds of instruction permitted in elementary and secondary schools versus what is allowed in institutions of higher learning. In his 1996 State of the Union Address, President Bill Clinton announced that the "age of big government is over." Some Republicans accused him of cynically appropriating their themes, while many Democrats thought he was betraying the principles of the New Deal and the Great Society. Mark Tushnet argues that Clinton was stating an observed fact: the emergence of a new constitutional order in which the aspiration to achieve justice directly through law has been substantially chastened. Tushnet argues that the constitutional arrangements that prevailed in the United States from the 1930s to the 1990s have ended. We are now in a new constitutional order--one characterized by divided government, ideologically organized parties, and subdued constitutional ambition. Contrary to arguments that describe a threatened return to a pre-New Deal constitutional order, however, this book presents evidence that our current regime's animating principle is not the old belief that government cannot solve any problems but rather that government cannot solve any more problems. Tushnet examines the institutional arrangements that support the new constitutional order as well as Supreme Court decisions that reflect it. He also considers recent developments in constitutional scholarship, focusing on the idea of minimalism as appropriate to a regime with chastened ambitions. Tushnet discusses what we know so far about the impact of globalization on domestic constitutional law, particularly in the areas of international human rights and federalism. He concludes with predictions about the type of regulation we can expect from the new order. This is a major new analysis of the constitutional arrangements in the United States. Though it will not be received without controversy, it offers real explanatory and predictive power and provides important insights to both legal theorists and political scientists.

Trata-se de uma reconstrução histórico-conceitual e análise de validade das sanções políticas tributárias no Direito brasileiro, concebidas estas como medidas restritivas de direitos, introduzidas pelo Poder Público com a finalidade de facilitar a fiscalização e de promover efetividade à arrecadação das receitas públicas. A validade destas medidas é questionada pela doutrina majoritária e, ao menos no discurso, rechaçada também pela jurisprudência brasileira. O emprego da expressão, com suas impropriedades semânticas, é uma construção doutrinária e jurisprudencial que, até onde se tem registros, remonta a meados do século XX. É curioso observar que, decorridos quase cem anos do início das discussões em torno da validade das sanções políticas, não há, na legislação tributária brasileira, qualquer referência expressa a esta categoria de sanções. No presente trabalho, o autor rejeita a qualificação das sanções políticas como medidas inválidas ou inconstitucionais, propondo sua definição a partir de dois elementos essenciais, a saber: (i) restrição de direitos fundamentais; e (ii) finalidade arrecadatória da medida. Mais do que legítimas, as sanções políticas são também necessárias para conferir efetividade à atividade arrecadatória do Estado, pois, a ação de execução fiscal, instrumento tradicional de cobrança, não atende mais às expectativas dos entes federados.

Hoje parece difícil compreender que os padres católicos já foram considerados funcionários públicos, ligados à estrutura administrativa do Estado. Também soa estranho que a elite imperial do Brasil do século XIX, formada em sua maior parte por juristas, tivesse o dever de manter um Estado recém independente e sua religião oficial, ao mesmo tempo em que estava preocupada em garantir liberdade religiosa e diferenciar os papéis da Igreja Católica e da Administração Pública ainda em formação. A pesquisa que deu origem ao livro teve por finalidade contextualizar e resgatar os debates jurídicos em torno do processo de secularização do Estado brasileiro no século XIX. A investigação recaiu sobre temas caros à vida cotidiana em um período que antecedeu a questão religiosa de 1873, crise aberta entre o Estado e a Igreja Católica que passaria a engrossar o caldo cultural contra a Monarquia. Como em toda obra historiográfica, aqui são desfeitos pequenos mitos que permeiam o senso comum, como as ideias de que não havia liberdade religiosa no Império, a ideia de que o liberalismo não combinava com uma religião oficial ou a de que a forma republicana de governo não seria conciliável com uma religião oficial.
