This collection discusses the concept of fraternity and examines the issue of its role in law. Since the end of World War II, fraternity has been cited in several national constitutional charters, in addition to the United Nations Universal Declaration of Human Rights. But is there space for fraternity in law? The contributions to this book form an ideal “bridge” between the past and present to trace the different pathways taken to address the meaning of fraternity, and to identify its possible legal relevance. The book lays out paths that have placed fraternity in varied and challenging legal contexts in an age of globalization and conflict, where the multiplicity of national and supranational sources of law seems to show its inadequacy to govern complexity, and coexistence between diversities that appear irreconcilable. The purpose is not to recover fraternity as a forgotten principle, but to reimagine it today to address the aim and force of law within a plurality of cultures. The analysis considers a possible universal dimension that models unity within diversity, and aspires to serve as a prologue to a transition from research to dialogue between different legal systems and traditions. The book will be of interest to academics and researchers working in the areas of Comparative Law, Legal History and Legal Philosophy.

The Spirit Of Utopia written by and has been published by Stanford University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2000-08 with Philosophy categories.

I am. We are. That is enough. Now we have to start. These are the opening words of Ernst Bloch's first major work, The Spirit of Utopia, written mostly in 1915-16, published in its first version just after the First World War, republished five years later, 1923, in the version here presented for the first time in English translation. The Spirit of Utopia is one of the great historic books from the beginning of the century, but it is not an obsolete one. In its style of thinking, a peculiar amalgam of biblical, Marxist, and Expressionist turns, in its analytical skills deeply informed by Simmel, taking its information from both Hegel and Schopenhauer for the groundwork of its metaphysics of music but consistently interpreting the cultural legacy in the light of a certain Marxism, Bloch's Spirit of Utopia is a unique attempt to rethink the history of Western civilizations as a process of revolutionary disruptions and to reread the artworks, religions, and philosophies of this tradition as incentives to continue disrupting. The alliance between messianism and Marxism, which was proclaimed in this book for the first time with epic breadth, has met with more critique than acclaim. The expressive and baroque diction of the book was considered as offensive as its stubborn disregard for the limits of "disciplines." Yet there is hardly a "discipline" that didn't adopt, however unknowingly, some of Bloch's insights, and his provocative associations often proved more productive than the statistical account of social shifts. The first part of this philosophical meditation--which is also a narrative, an analysis, a rhapsody, and a manifesto--concerns a mode of "self-encounter" that presents itself in the history of music from Mozart through Mahler as an encounter with the problem of a community to come. This "we-problem" is worked out by Bloch in terms of a philosophy of the history of music. The "self-encounter," however, has to be conceived as "self-invention," as the active, affirmative fight for freedom and social justice, under the sign of Marx. The second part of the book is entitled "Karl Marx, Death and the Apocalypse." I am. We are. That's hardly anything. But enough to start.

"A complex, intellectually jarring, and valuable book, one which reveals how early America became her true self as we now know her." --Kirkus Reviews The United States is currently experiencing a crisis of citizenship and democracy. For many of us, there is a sense of forlornness caused by losing sight of human connectedness and the bonds of community. Originally published in 1973, and long out of print, The Idea of Fraternity in America is a resonant call to reclaim and restore the communal bonds of democracy by one of the most important political theorists of the twentieth century, Wilson Carey McWilliams. This sprawling and majestic book offers a comprehensive and original interpretation of the whole range of American historical and political thought, from seventeenth-century White Puritanism to twentieth-century Black American political thought. In one sense, it is a long and sustained reflection on the American political tradition, with side glances at other cultures and other traditions; in another sense, it is an impressive beginning to an original and comprehensive theory of politics, rooted in a new reading of a vast array of relevant sources. Speaking with a prescience unmatched by his contemporaries, McWilliams argues that in order to address the malaise of our modern democracy we must return to an ideal of our past: fraternity, a relation of affection founded on shared values and goals. This 50th anniversary edition, which offers a critique of the liberal tradition and a new social philosophy for the future, contains a new introduction from McWilliams's daughter, Susan McWilliams Barndt. She writes, "At a time when many Americans are wondering how we got to where we are today . . . this book demonstrates that there is in fact a lot of precedent for what feels so unprecedented in contemporary American politics."

Special Educational Needs And Inclusive Practices written by Fabio Dovigo and has been published by Springer this book supported file pdf, txt, epub, kindle and other format this book has been release on 2017-01-28 with Education categories.

"Today, school is becoming a rapidly changing learning environment. Thinking about students as a homogeneous population is no longer allowed, as diversity – in terms of culture, language, gender, family organisation, learning styles and so on – has emerged as a key challenge for education today. The debate on Special Educational Needs largely reflects this challenge, as working in school implies careful reconsideration of what we mean by “normal” and “special”. Current educational intervention is generally based on a deficit and “within-child” model of facing SEN, whereas very little attention is given to the role of learning environments. The focus is on the child more than on the whole class, and on cognition and technical provisions more than on affective, sociocultural and community dimensions of learning. Conversely, regarding students and their needs as “hidden voices” allows us to adopt a transformative approach which sees diversity as a stimulus for the development of educational practices that might benefit all children and help school to become an inclusive and “moving” organisation. The aim of the book is twofold: on the one hand, it offers a systematic overview of the inclusive education state-of-the-art in six countries (Germany, Italy, Norway, Sweden, UK, and USA) based on the contributions by well-known scholars such as Christy Ashby, Barbara Brokamp, Fabio Dovigo, Kari Nes, Mara Westling Allodi, Tony Booth, and Beth Ferri; on the other hand, the book analyses five cases of good practices of inclusion related to different subjects and school levels."
