Despite the theoretical and practical importance of the question of conflict between treaties, little has been written on the subject. This monograph fills this gap by providing a detailed analysis of the main issues. The book is divided into three parts. The first deals with the definition of conflict, causes of conflict, and different types of conflict. The second part examines different sources of international law in order to identify rules of international law relating to the resolution of conflicts. The third part addresses the actual process of resolving conflicts between treaties. After describing different stages of treaty conflict-resolution, it discusses some special principles advanced for resolving conflicts between certain types of treaties, namely, those relating to the protection of human rights, those concerning dispute settlement, and treaties dealing with private law issues.

La négociation est une activité sociale, qui accapare de plus en plus les hommes désireux de résoudre les conflits qui opposent les groupes, organisations, nations auxquels ils appartiennent. L'actualité sociale et internationale est nourrie de ces discussions, souvent ardues, où les éclats, impasses, ruptures, le disputent aux communiqués lénifiants, protocoles d'accord plus ou moins ambigus. Mais très peu d'ouvrages ont tenté de faire une analyse systématique du déroulement des négociations, et des conditions qui facilitent ou entravent les discussions. Ce livre est un essai pour remédier à ce manque. Résolument situé dans le champ de la psychologie sociale, l'auteur se centre essentiellement sur les activités des négociateurs réunis autour du tapis vert. Il décrit les rôles, les phases, les processus à l'œuvre dans la négociation, les facteurs qui influent sur son déroulement, pour s'attarder sur le rôle et l'influence du médiateur. Personnage important et parfois capital, le médiateur doit pourtant, pour réussir, adapter son comportement au type particulier de négociation qu'il conduit. Car le médiateur efficace est celui qui, par cet ajustement, favorise et utilise la volonté d'accord des parties en présence. Cet ouvrage apportera aux nombreux praticiens de la négociation le fruit d'études théoriques et expérimentales.
