Despite the theoretical and practical importance of the question of conflict between treaties, little has been written on the subject. This monograph fills this gap by providing a detailed analysis of the main issues. The book is divided into three parts. The first deals with the definition of conflict, causes of conflict, and different types of conflict. The second part examines different sources of international law in order to identify rules of international law relating to the resolution of conflicts. The third part addresses the actual process of resolving conflicts between treaties. After describing different stages of treaty conflict-resolution, it discusses some special principles advanced for resolving conflicts between certain types of treaties, namely, those relating to the protection of human rights, those concerning dispute settlement, and treaties dealing with private law issues. This "Liber Amicorum" is published at the occasion of Judge Lucius Caflisch's retirement from a distinguished teaching career at the Graduate Institute of International Studies of Geneva, where he served as Professor of International Law for more than three decades, and where he has also held the position of Director. The "Liber Amicorum Lucius Caflisch" covers different fields in which Judge Caflisch has excelled in his various capacities, as scholar, representative of Switzerland in international conferences, legal adviser of the Swiss Foreign Affairs Ministry, counsel, registrar, arbitrator and judge. In Canada's Eastern Arctic and Greenland, the Inuit have been the majority for centuries. In recent years, they have been given a promise from Canadian and Danish governments that offers them more responsibility for their lands and thus control over their lives without fear of being outnumbered by outsiders. The Arctic Promise looks at how much the Inuit vision of self-governance relates to the existing public governance systems of Greenland and Nunavut, and how much autonomy there can be for territories that remain subordinate units of larger states. By means of a bottom-up approach involving cultural immersion, contextual, jurisprudential, and historical legal comparisons of Greenland and Nunavut, The Arctic Promise examines the forms, evolution, and scope of the right to autonomy in these Arctic jurisdictions. Loukacheva argues that the right to autonomy should encompass or protect Inuit jurisdiction in legal systems and the administration of justice, and should allow the Inuit direct participation in international affairs where issues that affect their homelands are concerned. The Arctic Promise deals with areas of comparative constitutional law, international law, Aboriginal law, legal anthropology, political science, and international relations, using each to contribute to the understanding of the right to indigenous autonomy.
