Nesta pesquisa, destacaremos as configurações político-criminais do modelo brasileiro de combate às drogas, mais precisamente acerca da sua estrutura de punibilidade, destacando a Lei vigente no 11.343/2006 e seus hiatos de criminalização. Partindo da premissa de que a generalidade normativa é campo permissivo de atuação do racismo estrutural, aqui consubstanciado na necropolítica e no encarceramento em massa capitaneados pelo Estado, analisamos dados referentes ao sistema penitenciário nacional, tendo sido selecionado o INFOPEN-2017, bem como dados do MPE-BA e DPE-BA. Os números nacionais demonstraram que a maior parte da população encarcerada é composta por homens, jovens, negros, de baixa escolaridade e de baixa renda, sendo que o crime imputado foi o de tráfico de drogas em cerca 30% dos casos. Ademais, os dados analisados permitiram constatar a tendência punitivista do Estado brasileiro, tanto a nível macro como quando do recorte sobre os crimes previstos na Lei de Drogas, bem como permitiu inferir que a ausência de concretude nos critérios estabelecidos pela lei para a definição da conduta acaba por inflacionar o número de casos de tráfico em detrimento das situações classificadas como uso. Destarte, é imprescindível que passemos a discutir a necropolítica e o encarceramento em massa não como uma questão de justiça criminal, mas como uma questão de justiça racial e de direitos civis.
