Il primo, anche in ordine di pubblicazione, è il volume di Carmela Marchese, La tutela del cane randagio nelle pubbliche amministrazioni, che si occupa segnatamente della prospettiva del cane all’interno della società civile e, soprattutto, di come viene gestito il fenomeno del randagismo da parte delle Istituzioni. Il secondo volume che lambisce la tematica oggetto della presente pubblicazione è quello intitolato Convivere con gli animali: le ricadute civili e penali della responsabilità per fatto dell’animale. Quest’ultimo affronta i profili civilistici e penalistici derivati dalla “onnipresenza animale” nella vita contemporanea (secondo una felice espressione utilizzata dalla professoressa Silvia Buzzelli nel volume I giorni scontati. Appunti sul carcere, 2012) e, per meglio dire, quali sono le conseguenze della convivenza uomo-animale nel tessuto sociale contemporaneo, limitatamente agli animali per cui è identificabile un proprietario/custode/utilizzatore/ che è responsabile per il fatto dell’animale. - La situazione muta prospettiva se si puntano i riflettori sugli animali selvatici o randagi/abbandonati. Alla gestione dei danni provocati da questi ultimi è dedicato il presente volume, mentre per il risarcimento danni provocati dalla fauna selvatica sarà pubblicato un volume ad hoc. - La presente divulgazione – da utilizzarsi, per alcuni profili, in combinazione con il volume n. 7 – si sofferma sull’indagine relativa al legittimato passivo di azioni di responsabilità per risarcimento del danno provocato da animali randagi, alla luce del variegato e stratificato panorama normativo costituito dalla legge quadro n. 281/91 e dalle leggi regionali di esecuzione. Un’ampia casistica – quale emergente dalle pronunce delle corti della Penisola – dipinge lo stato attuale della giurisprudenza e costituisce un primo strumento per rinvenire la frammentata disciplina normativa e per consentire agli operatori di valutare le strategie difensive per la migliore tutela del danneggiato. - Il volume, poi, oltre a rinviare alle azioni positive perseguibili per arginare un fenomeno che non accenna a ridimensionarsi, con importanti ricadute anche sul bilancio degli enti pubblici, critica talune risposte deleterie (canili lager) o, comunque, illecite (ordinanze che vietano di alimentare i randagi). Infine, uno spazio è dedicato alle connessioni tra randagismo e Codice della Strada, come innovato dalla legge n. 120 del 2010 e dai decreti attuativi.

La legislazione di derivazione comunitaria afferma che gli animali sono esseri senzienti e che essa tutela il benessere animale in allevamento, durante il trasporto ed al momento della macellazione. Sebbene questa legislazione sembri essere “science based” in realtà non tiene conto degli sviluppi scientifici sulla vita emotiva e relazionale degli animali non umani, poiché l’animale non umano viene analizzato solo al fine di definire i parametri entro cui può definirsi in condizione di benessere esclusivamente in un’ottica di utilizzo-sfruttamento. Questo è dovuto al fatto che l’interesse delle normative non è il “benessere” degli animali per se ed il loro riconoscimento come esseri senzienti nelle normative ha, come unica finalità, quella di rimarcare la connessione tra animale sano e cibo sano dal momento che un animale che diventerà cibo darà cibo sano quanto più da sano ha vissuto e quanto più da sano è morto. Il Veterinario, quindi, non è quella figura che garantisce il vero benessere ma solo colui che garantisce un buono stato fisico e sanitario dell’animale che dovrà poi dare un prodotto alimentare sano. Non è un caso, infatti, che la spinta propulsiva a prendere “seriamente” in considerazione il “benessere” animale sia stata data dalla diffusione della malattia conosciuta comunemente come BSE. Nonostante l’obiettivo di tutela delle normative sia l’essere umano, in queste, manca del tutto, un esplicito richiamo al principio di precauzione e quindi una valutazione dei vari tipi di rischi correlati all’allevamento di animali destinati alla produzione alimentare. Per questi motivi le sofferenze di questi animali sono, in numero, sistematicità e modalità ampiamente ignorate

The time of Carnival represents a “wild” time at the end of winter and pointing to the beginning of a new season. It is characterized by the irruption of border figures, animal masks, characters which recall the world of the dead and which bring within themselves the germ of a vital force, of the energy that produces the reawakening of nature and announces the growth and fertility of the new crops. This wild domain shows itself under the shapes of a contiguity between human and animal: the costumes, the masks, refer to a world in which the characteristics of the human and those of the animal are fused and intertwined. Among these figures, in particular, emerge those of the Wild Man, the human being who takes on animal-like attributes and aspects, and of the Bear, the animal that, more than all the others, gets as close as possible to the human and seems to reflect a deformed image of it. This book takes an inductive approach to the question of whether there is a hierarchy in international law, with human rights obligations trumping other duties. It assesses the extent to which such a hierarchy can be said to exist through an analysis of the case law of national courts. Each chapter of the book examines domestic case law on an issue where human rights obligations conflict with another international law requirement, to see whether national courts gave precedence to human rights. If this is shown to be the case, it would lend support to the argument that the international legal order is moving toward a vertical legal system, with human rights at its apex.
