La fácil disolubilidad del matrimonio en nuestro Derecho y la proliferación de las parejas no casadas conducen a que con alguna frecuencia, un nuevo cónyuge o compañero se avengan a reconocer como hijo propio al niño que no tiene previamente determinada su filiación paterna, y ello tiene como propósito el tratar de procurar cohesión y estabilidad a la familia. Pero si la nueva unión no resulta luego ser tan estable como se esperaba, no es extraño que el reconocedor trate de impugnar el reconocimiento que hizo, por la vía del artículo 141 del Código civil, o hasta la propia filiación, por la vía del artículo 140. Y ello, a veces incluso de acuerdo con la madre.Esta obra analiza con detalle las posibles soluciones que plantea el reconocimiento de complacencia. Un reconocimiento que según la Dirección General de los Registros y del Notariado es nulo de pleno derecho y no podrá ser inscrito. Recientemente, el Tribunal Supremo ha sentado una doctrina que ya está dando que hablar: cabe la impugnación de la paternidad por el reconocedor, aunque habrá de ser según los dictados del artículo 136 del Código civil, esto es, solamente se podrá intentar durante el año posterior a la inscripción de la filiación en el Registro Civil (STS de 15 de julio de 2016).Pero cada vez son más quienes piensan que en materia de filiación las piezas de la verdad biológica no siempre encajan con la debida simetría en el instituto de la filiación. De hecho, en ese reconocedor no hay engaño ni error: no es que declarara ser padre por creer equivocadamente que lo era, sino que declaró que era padre de quien él sabía que no era hijo suyo. Él mismo estableció la filiación a sabiendas de la inexistencia del vínculo biológico. Ana Silvia Gallo mantiene la opinión de que se debe impedir la impugnación a estas personas por aplicación del carácter indisponible del estado civil y de la doctrina de los actos propios, por exigencias de seguridad jurídica en las relaciones familiares y de la propia dignidad del individuo, y porque lo contrario se opone al interés superior del hijo, que es el más necesitado de protección.Ana Silvia Gallo, Doctora por la Universidad de Zaragoza, es profesora de Derecho civil en la Universidad EAFIT MedellínColombia y especialista en Derecho de familia. Since the 19th century, there have been two opposing perspectives on Cuban racial identity: one that frames Cubans as white, and one that sees them as racially mixed based on acceptance of African descent.
