7 Einleitung Einleitung Thomas Philipp, Mandana Biegi, Jurgen Forster, Henrique Ricardo Otten Die Verhaltnisbestimmung von Demokratie, Recht und Legitimitat ist ein zentrales Thema politikwissenschaftlicher Reflexion. Wenn hier erneut die Beziehung z- schen Demokratie und Recht befragt werden soll, dann geschieht dies vor allem deshalb, weil die Klammer, die beide miteinander verbindet, namlich der Staat, - genwartig neue Positionierungen und Rollenzuschreibungen erfahrt. Einerseits v- liert der territorial verfasste Rechtsraum an Bedeutung, andererseits zeigt sich, dass unter der Bedingung postnationaler Konstellationen der Bedarf an rechtlicher V- fasstheit zunimmt und das Bedurfnis nach demokratischer Legitimation grosser wird. Die Konflikte und Widerspruche der aktuellen Entwicklung europaischer Integration sind dafur ebenso ein Beispiel wie die Debatte uber die Legitimitat von Nicht- Regierungsorganisationen in den internationalen Beziehungen. Durch die Ereignisse des 11. September 2001 gewinnt das Nachdenken uber Recht und Demokratie in den internationalen Beziehungen zusatzlich an Brisanz, symbolisiert dieses Datum doch das erneute Aufbrechen uberwunden geglaubter Spannungen zwischen dem Handeln demokratisch legitimierter Regierungen und der rule of law. Mittels der Begriffe Demokratie, Recht und Legitimitat wird ein weites Them- feld abgesteckt. Dies geschieht ganz bewusst, weil sich nur so im Ansatz die v- schiedenen Entwicklungen erfassen lassen, die dieses triadische Verhaltnis best- men und verandern. Die in diesem Sammelband enthaltenen Beitrage analysieren also sowohl die gegenwartige Relation von Demokratie, Recht und Legitimitat als auch mogliche Perspektiven im 21. Jahrhundert. Dies schliesst selbstverstandlich nicht aus, den Blick zuruckzuwenden. Im Gegenteil, erst eine fundierte Analyse vorausgegangener Prozesse und Ereignisse macht es uberhaupt moglich, Entwi- lungen aufzuzeigen."

This volume explores the reasons for Hans Kelsen’s lack of influence in the United States and proposes ways in which Kelsen’s approach to law, philosophy, and political, democratic, and international relations theory could be relevant to current debates within the U.S. academy in those areas. Along the way, the volume examines Kelsen’s relationship and often hidden influences on other members of the mid-century Central European émigré community whose work helped shape twentieth-century social science in the United States. The book includes major contributions to the history of ideas and to the sociology of the professions in the U.S. academy in the twentieth century. Each section of the volume explores a different aspect of the puzzle of the neglect of Kelsen’s work in various disciplinary and national settings. Part I provides reconstructions of Kelsen’s legal theory and defends that theory against negative assessments in Anglo-American jurisprudence. Part II focuses both on Kelsen’s theoretical views on international law and his practical involvement in the post-war development of international criminal law. Part III addresses Kelsen’s theories of democracy and justice while placing him in dialogue with other major twentieth-century thinkers, including two fellow émigré scholars, Leo Strauss and Albert Ehrenzweig. Part IV explores Kelsen’s intellectual legacies through European and American perspectives on the interaction of Kelsen’s theoretical approach to law and national legal traditions in the United States and Germany. Each contribution features a particular applications of Kelsen’s approach to doctrinal and interpretive issues currently of interest in the legal academy. The volume concludes with two chapters on the nature of Kelsen’s legal theory as an instance of modernism.

Human rights abuses and violations in Saudi Arabia attract international condemnation. But within the country, an Islamic civil rights movement, 'HASM', has called for change. While its members have received international human rights awards, the Saudi authorities have persecuted and imprisoned them. This book is the first to study human rights in the kingdom from the perspective of these prominent Saudi civil rights activists, uncovering the actual ideas that motivate their activism. Based on analysis of the group's texts, the book highlights that HASM neither supports an overthrow of the government, of which they are accused, nor are they “liberal” advocates of universal human rights. Their complex thought is a contribution to contemporary Islamic discourse because they make a case for 'peaceful civil jihad' through the protection of citizens' basic rights, but within a rigid, Salafist interpretation of social affairs that imposes heavy limits on politics, human rights and democracy. Furthermore, HASM's texts use war rhetoric and anti-Semitic language, with different arguments and words for domestic or international audiences. The most comprehensive text on this Islamic civil rights movement, the book employs detailed discourse analysis and includes sources from HASM texts in both Arabic and English.

In einer Vergleichsanalyse, die auf der Prämisse einer massiven Interaktion der Kulturen in jener Zeit basiert, lässt sich nun nachweisen, dass das erste monumentale Rechtswerk im Islam, die Zāhir ar-riwāya des Šaybānī, strukturell und inhaltlich auf dem Rhēton beruht – einer griechischen Version jenes Regelwerkes, das später in Europa als Corpus Iuris Civilis Verbreitung fand. Inspiriert durch die byzantinische Reichsrechtsidee kodifizierten muslimische Staatsjuristen in Bagdad das islamische „Reichsrecht“, das aber angesichts der Opposition frommer Überlieferer durch Traditionen legitimiert werden musste. Nachdem sich das Reichsrecht in weiten Teilen des Kalifats etabliert hatte, bewirkte der revolutionäre Triumph der Orthodoxie Mitte des 9. Jahrhunderts dessen Übergang in ein Juristenrecht, das nun in den Händen unabhängiger Gelehrter lag.

The rapid shift of German elite groups' political loyalties away from Nazism and toward support of the fledgling democracy of the Federal Republic, in spite of the continuity of personnel and professional structures, has surprised many scholars of postwar Germany. The key, Hayse argues, lies in the peculiar and paradoxical legacy of these groups' evasive selective memory, by which they cast themselves as victims of the Third Reich rather than its erstwhile supporters. The avoidance of responsibility for the crimes and excesses of the Third Reich created a need to demonstrate democratic behavior in the post-war public sphere. Ultimately, this self-imposed pressure, while based on a falsified, selective group memory of the recent past, was more important in the long term than the Allies' stringent social change policies.
