Excerpt from Relacion de los Debates de la Convencion de California, Sobre la Formacion de la Constitucion de Estado, en Septiembre y Octubre de 1849 Las leyes de California que no se opongan las leyes, constitucion y tratados de los Estados Unidos, continuan en fuerza y vi or2 y estarán vigentes hasta que sean derogadas por la autoridad competente. Cualquiera ue sea a ¡dea que se tenga con respecto al derecho que tiene el pueblo reemplazar interinamente 108 empleados del Gobierno existente, con otros que nombre una Legisla tura territorial provisional, no puede ponerse en duda que las leyes vigentes deben continuar enfuerza y vigor hasta que sean reemplazadas con otras y mandadas ejecutar por el poder competente. Aquel poder, segun el tratado de paz, y por la naturaleza del asunto, está representado en el Congreso. En este respecto, la situacion de California es muy diferente de la del Oregon. Este último país carecía de leyes, mientras que el primero tiene un sistema de leyes que, aunque algo defectuoso y su'eto muchos cambios y modificaciones, debe continuar vigente hasta que lo derogue el poder legisíativo competente. La situacion de California es casi idéntica la de Luisiana, y las decisiones del Tri bunal Supremo reconociendo la validez de las leyes que existían en aquel país antes de formar parte de los Estados Unidos, siempre que aquellas no se opusiesen la constltuc1on y leyes de los Estados Unidos, 6 que hubiesen sido derogadas por el poder legislativo, n°s suministran, en nuestra presente posicion, una guia clara y segura.
