To understand the most contentious issues around religious liberty, this volume provides influential philosophical ideas from the U.S.’s founding to the present day and key U.S. Supreme Court judgements to ask how the two twin pillars of religious freedom — free exercise and the limit on religious establishment — unfold in daily life. A Penguin Classic With the Penguin Liberty series by Penguin Classics, we look to the U.S. Constitution’s text and values, as well as to American history and some of the country’s most important thinkers, to discover the best explanations of our constitutional ideals of liberty. Through these curated anthologies of historical, political, and legal classic texts, Penguin Liberty offers everyday citizens the chance to hear the strongest defenses of these ideals, engage in constitutional interpretation, and gain new (or renewed) appreciation for the values that have long inspired the nation. Questions of liberty affect both our daily lives and our country’s values, from what we can say to whom we can marry, how society views us to how we determine our leaders. It is Americans’ great privilege that we live under a Constitution that both protects our liberty and allows us to debate what that liberty should mean.

This volume provides in a single source a thorough grounding in the origin, development, and current controversies surrounding the free practice of religion. The first boatloads of European settlers did not come to America advocating religious tolerance. They came seeking the freedom to practice their own religion. Other sects, they believed, were wrong at best and, at worst, not to be tolerated. The question of what constitutes "legitimate," constitutionally protected religious practice has been debated ever since. Does it include the use of peyote? Polygamy? Refusing medical care for a sick child? Freedom of Religion follows the evolving understanding of the concept of religious freedom from Great Britain to the New World, through hundreds of U.S. courtrooms, to the volatile modern-day issues of school prayer and faith-based initiatives. The thorough, responsible, and cool-headed analysis presented here offers readers a solid grounding in the constitutional issues behind the headlines.

This is a print on demand book and is therefore non- returnable. In this volume, several leading scholars harvest the best of Western thinking on religious liberty. An opening chapter shows how religious liberty emerged slowly in the West through centuries of cruel experience and growing enlightenment. Separate chapters thereafter take up the unique role of such titans as Marsilius, Luther, Calvin, Hobbes, Locke, Rousseau, Burke, Tocqueville, and the American framers in the Western drama of religious liberty. From widely divergent experiences, these titans discovered the cardinal principles of religious liberty -- religious pluralism and toleration, religious equality and non- discrimination, liberty of conscience and association, freedom of expression and exercise. From widely discordant convictions, they distilled the most enduring models of church and state and of religion and law in the West -- from the organic models of earlier centuries to the dualistic models of more recent times. Taking Liberties written by Robert Boston and has been published by Prometheus Books this book supported file pdf, txt, epub, kindle and other format this book has been release on 2014-03-04 with Political Science categories.

A concise and lucid explanation of what religious freedom is and isn't Increasingly, conservative religious groups are using religious liberty as a sword to lash out at others. In this forcefully argued defense of the separation of church and state, Robert Boston makes it clear that the religious freedom guaranteed in the First Amendment is an individual right, the right of personal conscience, not a license allowing religious organizations to discriminate against and control others. The book examines the controversy over birth control, same-sex marriage, religion in public schools, the intersection of faith and politics, and the "war on Christmas," among other topics. Boston concludes with a series of recommendations for resolving clashes between religious liberty claims and individual rights.

Virtually everyone supports religious liberty, and virtually everyone opposes discrimination. But how do we handle the hard questions that arise when exercises of religious liberty seem to discriminate unjustly? How do we promote the common good while respecting conscience in a diverse society? This point-counterpoint book brings together leading voices in the culture wars to debate such questions: John Corvino, a longtime LGBT-rights advocate, opposite Ryan T. Anderson and Sherif Girgis, prominent young social conservatives. Many such questions have arisen in response to same-sex marriage: How should we treat county clerks who do not wish to authorize such marriages, for example; or bakers, florists, and photographers who do not wish to provide same-sex wedding services? But the conflicts extend well beyond the LGBT rights arena. How should we treat hospitals, schools, and adoption agencies that can't in conscience follow antidiscrimination laws, healthcare mandates, and other regulations? Should corporations ever get exemptions? Should public officials? Should we keep controversial laws like the Religious Freedom Restoration Act, or pass new ones like the First Amendment Defense Act? Should the law give religion and conscience special protection at all, and if so, why? What counts as discrimination, and when is it unjust? What kinds of material and dignitary harms should the law try to fight-and what is dignitary harm, anyway? Beyond the law, how should we treat religious beliefs and practices we find mistaken or even oppressive? Should we tolerate them or actively discourage them? In point-counterpoint format, Corvino, Anderson and Girgis explore these questions and more. Although their differences run deep, they tackle them with civility, clarity, and flair. Their debate is an essential contribution to contemporary discussions about why religious liberty matters and what respecting it requires.
