Whereas businesses tend to view all things in terms of risk and return, some elements of human rights that are integral to human dignity do not lend themselves to this characterization. In the story of the progressive detachment of the economic sphere from society drawn by Polanyi (1944), human rights would still provide a limit, if only theoretical, to the growth of the market sphere which gives an exchange value to everything. But if we try to re-embed the economy in society by making human rights part of the norms businesses should apply, is there not a danger of seeing human rights become another element to be subjected to calculations and integrated into economic rationality, their value thus reduced by being but a means for profit-maximization? The UNGP, well-aware of the difference between the two rationalities we have identified, recognizes the possibility of integrating them both in the same risk management devices as long as their logics remain distinct. But we claim that this distinction does not hold in practice and cannot take us beyond the prioritization of some human rights violations. Risks are endowed with a positivity that calls for their optimization, not their complete suppression, hence the paradox of a soft law tool that cannot but perpetuate human rights violations even if through the reduction of their most damaging examples. We explore this tension through the study of human rights risk assessments tools and of the combination of different strands of risk management inside one company. By the same token we deepen the connection between the "business and human rights" and the "sustainable procurement" fields.
