The politics of criminal sentencing has recently crystallised around the issue of whether and how a system of structured sentencing should inform judicial approaches to punishing criminals. Increasingly, structured sentencing guidelines are being introduce to frame judicial discretion. This volume is the first to examine the experience in England and Wales in the light of international developments. This collection of essays begins with a clear and concise history of the guidelines as well as a description of how they function. Topics addressed include the effect of guidelines on judicial practice, the role of public opinion in developing sentencing guidelines, the role of the crime victim in sentencing guidelines, and the use of guidelines by practicing barristers. In addition, the international dimension offers a comparative perspective: the English guidelines are explored by leading academics from the United States and New Zealand. In the 2010 green paper, Breaking the cycle (Cm. 7972, ISBN 9780101797221), the Government set out plans for overhauling the way sentences served in the community are used, to increase the public's confidence in them and to tackle the continuing problem of reoffending. This consultation explores in more detail how that can be achieved and sets out proposals for radical reforms to the way in which sentences served in the community operate. Victims and society have a right to expect that wrongdoing results in punishment, and that they will be protected from further reoffending. Ultimately the goal must be to reduce crime and see fewer victims. Community orders need to be demanding and rigorously enforced so that they are as punitive and effective as a custodial sentence. The Government is clear that short prison sentences have their place, and this consultation does not seek to replace them with community sentences. But where an offender is on the cusp of custody, sentencers should have a genuine choice. Views are sought here on how that can be done through a tough package of requirements. The sentencing guidelines written by the U.S. Sentencing Commission for the federal crime courts were designed to lead to uniform the just punishments for convicted criminals. How well did the Commission's judgments about what were just punishments compare to the view of the American public? Using data from a 1994 national household survey, the authors compare the punishments described by the Commission to those desired by the public. Contrary to the frequency claims of excessive leniency on the part of judges that are often asserted by journalists and shapers of opinions, Rossi and Berk find strong correspondence between the median sentences deemed appropriate by the public and the sentences prescribed by the guidelines. Although the authors conclude that the Commission was able to match prescribed punishments closely to the American consensus for most crimes, in one category -- drug trafficking offenses -- the guidelines were much harsher in dealing with offenders. The national survey used a factorial survey as its design strategy, allowing for analysis of a large variety of federal crimes and variations in the social characteristics of convicted felons. A wealth of detail, along with ample graphic and tabular illustrations, extends the book's application to issues of consensus and variations in punitiveness by region and socioeconomic characteristics of respondents.
