Da das Thema so komplex ist sollen hier natürlich nicht alle Punkte behandelt werden. Deshalb wird im Zuge dessen auch nicht auf Depot-, Termingeschäft oder Derivate eingegangen, sondern nur auf Wertpapiere, da diese die Hauptanlage im Bereich der Vermögensverwaltung bilden und sich dort vieles bzgl. Gesetzesänderungen in den letzten Jahren ergeben hat. Der Schwerpunkt der vorliegenden Arbeit, liegt daher bei den Pflichten der Parteien Kunde (Anleger/Vermögensinhaber) und Bank (Vermögensverwalter), als Kreditinstitut, im Bereich der Vermögensverwaltung. Hier soll aber natürlich, wie die Überschrift schon verlauten lässt, nicht nur auf die Pflichten der Vermögensverwaltung allgemein, sondern auch explizit auf den Vermögensverwaltungsvertrag, teilweise sehr speziell mit einem Kreditinstitut eingegangen werden. Wenn man speziell schreibt, weiß man natürlich, dass es sicher auch andere Formen geben muss. Diese werden nach einer kurzen historischen Einführung der rechtlichen Änderungen, ziemlich am Anfang der Arbeit kurz etwas näher erläutert. Des Weiteren werden die einzelnen Arten der Vermögensverwaltung erklärt und die verschiedenen Vertragsmodelle ebenso. Inhalt, Form und Beendigungsmöglichkeiten des Vertrages an sich, sowie Gestaltungsmöglichkeiten dessen werden in einzelnen, eigenen Kapiteln behandelt. Im Anschluss wird dann auch noch auf die Haftung der Parteien eingegangen, die eine wichtige Rolle für bspw. den Vermögensverwalter spielt. Dabei werden im Verlauf der Arbeit insbesondere die rechtlichen Änderungen, die sich aufgrund der Einführung und Umsetzung der europäischen
