Tax rules in non-tax agreements is a topic of great relevance in practice. Yet, up to now, this area of tax law has been generally neglected by researchers. The aim of this book is to close this gap in tax law research and to analyse the provisions of international agreements and similar legal instruments under international law which provide for a special domestic law tax treatment for specific individuals and international organizations. Twenty-four national reports from countries across the globe have been compiled and are published in this volume. Seventy experts, including the authors of the national reports, convened for a joint conference on "Tax Rules in Non-Tax Agreements" in Rust (Austria) from 7-9 July 2011. The national reports focus on the interaction of tax rules in non-tax agreements with the corresponding tax treaty rules. Moreover, possible matters of dispute regarding the justification of these tax rules within the legal and political frameworks of the different states are given much attention. Germany in the 20th century endured two world wars, a failed democracy, Hitler's dictatorship, the Holocaust, and a country divided for 40 years after World War II. But it has also boasted a strong welfare state, affluence, liberalization and globalization, a successful democracy, and the longest period of peace in European history. A History of Twentieth-Century Germany provides a survey of German history during a century of extremes. Ulrich Herbert sees German history in the 20th century as determined by two contradictory perspectives. On one hand, there are the world wars and great catastrophes that divide the country's history into two parts-before and after 1945. Germany is the birthplace of radical ideologies of the left and right and the only country in which each ideology became the foundation of government. This pattern left its stamp on both the first and second halves of the century. On the other hand, the rise of modern industrial society led to decades of conflict over the social and political order regardless of which political system was in force. Considering these contradictory developments, Herbert tackles the questions of both the collapse in the first half of the century and the development from a post-fascist, ruined society to one of the most stable liberal democracies in the world in the latter half. Preface This book contains the proceedings of the International Tax Conference on the c- th th mon consolidated corporate tax base (CCCTB) that was held in Berlin on 15 – 16 may 2007. The conference was jointly organised by the German Federal Ministry of Finance, the Centre for European Economic Research (ZEW), Mannheim, and the Max Planck Institute (MPI) for Intellectual Property, Competition and Tax Law, Munich. More than 250 participants from all over Europe and other regions, scholars, politicians, business people and tax administrators, discussed the Eu- pean Commission’s proposal to establish a CCCTB. Three panels of tax experts evaluated the common tax base with respect to structural elements, consolidation, allocation, international aspects and administration. The conference made clear that the CCCTB has the potential to overcome some of the most intriguing problems of corporate income taxation within the Common Market. Common tax accounting rules substantially reduce compliance and administrative costs. Consolidation of a group’s profits and losses effects cro- border loss compensation which removes a major tax obstacle for European cro- border investment. At the same time, tax planning with respect to financing and transfer pricing is pushed back within the European Union. Moreover, as far as the CCCTB applies, member states are able to remove tax provisions that are targeted at cross border tax evasion and that might be challenged by the jurisdiction of the Eu- pean Court of Justice.
