Reconsidering Constitutional Formation Ii Decisive Constitutional Normativity written by Ulrike Müßig and has been published by this book supported file pdf, txt, epub, kindle and other format this book has been release on 2020-10-08 with Political Science categories.

This second volume of ReConFort, published open access, addresses the decisive role of constitutional normativity, and focuses on discourses concerning the legal role of constitutional norms. Taken together with ReConFort I (National Sovereignty), it calls for an innovative reassessment of constitutional history drawing on key categories to convey the legal nature of the constitution itself (national sovereignty, precedence, justiciability of power, judiciary as constituted power). In the late 18th and early 19th centuries, constitutional normativity began to complete the legal fixation of the entire political order. This juridification in one constitutional text resulted in a conceptual differentiation from ordinary law, which extends to alterability and justiciability. The early expressions of this 'new order of the ages' suggest an unprecedented and irremediable break with European legal tradition, be it with British colonial governance or the French ancien régime. In fact, while the shift to constitutions as a hierarchically 'higher' form of positive law was a revolutionary change, it also drew upon old liberties. The American constitutional discourse, which was itself heavily influenced by British common law, in turn served as an inspiration for a variety of constitutional experiments - from the French Revolution to Napoleon's downfall, in the halls of the Frankfurt Assembly, on the road to a unified Italy, and in the later theoretical discourse of twentieth-century Austria. If the constitution states the legal rules for the law-making process, then its Kelsian primacy is mandatory. Also included in this volume are the French originals and English translations of two vital documents. The first - Emmanuel Joseph Sieyès' Du Jury Constitutionnaire (1795) - highlights an early attempt to reconcile the democratic values of the French Revolution with the pragmatic need to legally protect the Revolution. The second - the 1812 draft of the Constitution of the Kingdom of Poland - presents the 'constitutional propaganda' of the Russian Tsar Alexander I to bargain for the support of the Lithuanian and Polish nobility. These documents open new avenues of research into Europe's constitutional history: one replete with diverse contexts and national experiences, but above all an overarching motif of constitutional decisiveness that served to complete the juridification of sovereignty. The soul rejoices in perceiving harmonious sound; when the sound is not harmonious it is grieved. From these affects of the soul are derived the name of consonances for the harmonic proportions, and the name of dissonances for the unharmonic proportions. When to this is added the other harmonie proportion whieh consists of the longer or shorter duration of musical sound, then the soul stirs the body to jumping dance, the tongue to inspired speech, according to the same laws. The artisans accommodate to these harmonies the blows of their hammers, the soldiers their pace. As long as the harmonies endure, everything is alive; everything stiffens, when they are disturbed.! Thus the German astronomer, Johannes Kepler, evokes the power of music. Where does this power come from? What properties of music enable it to stir up emotions which may go far beyond just feeling generally pleased, and which may express themselves, for instance, in weeping; in laughing; in trembling over the whole body; in a marked acceleration of breathing and heartbeat; in participating in the rhythm with the head, the hands, the arms, and the feet? From the beginning of musical theory the answer to this question has been sought in two different directions.

Aging and religion has been badly neglected in the field of Gerontology. This book, containing 13 chapters of original theory and research, is devoted to understanding the place that religion and spirituality hold in the lives of elderly persons. The authors, each experts in their own field, approach this issue from their backgrounds in the social sciences and the humanities. Overall this is a ground-breaking collection: It is one of the first attempts to seek to understand the role that religion plays in the lives of elderly persons. Based on their various multi-disciplinary perspectives, the authors make use of a variety of qualitative and quantitative methodologies as well as personal narrative and literature to grapple with this issue. Finally, the book is unique in that it addresses scholars and students, including the educated layman, rather than the professional alone.

A major new assessment of the "vanished kingdom" of the Polish-Lithuanian Commonwealth--one which recognizes its achievements before its destruction Richard Butterwick tells the compelling story of the last decades of one of Europe's largest and least understood polities: the Polish-Lithuanian Commonwealth. Drawing on the latest research, Butterwick vividly portrays the turbulence the Commonwealth experienced. Far from seeing it as a failed state, he shows the ways in which it overcame the stranglehold of Russia and briefly regained its sovereignty, the crowning success of which took place on 3 May 1791--the passing of the first Constitution of modern Europe.
