In diesem Buch werden die Wurzeln des deutschen Rechts in Siebenbürgen und dessen Entwicklung bis ins 16. Jahrhundert hinein untersucht. Im Zentrum der Betrachtung steht die Geschichte der Siedlungs- und Stadtrechtsentwicklung in Siebenbürgen sowie der wichtigsten Rechtskreise, die ihre Wurzeln alle im Magdeburger Recht hatten. Im Gegensatz zu der verbreiteten Ansicht, dass die weitgehenden Rechte der deutschen Siedler als königliche Gnadenakte für besondere Leistungen anzusehen seien, erkennt der Autor bestimmte, immer wieder auftretende Rechte und Pflichten der Siedler als Grundbedingung für das Funktionieren ihrer Siedlungen. Weiterhin untersucht werden die Bergrechte, die überregional wirkenden Zünfte und Zunftrechtslandschaften, die Rezeption des Römischen Rechts in Siebenbürgen sowie einzelne Wechselwirkungen mit ungarischen und walachischen Rechten. Dirk Moldt wurde mit einer diesem Buch zugrunde liegenden Arbeit an der TU Berlin promoviert.

This is a detailed and scholarly account of religious belief and conflict in the strategically important province of Inner Austria between 1580 and 1630. Regina Pörtner shows how Protestantization in the first half of the sixteenth century was linked to communication with the Protestants of the rest of the Empire, and to the failure of ecclesiastical reform in the church province of Salzburg, of which Styria formed part. The Protestant success of 1578, however, proved deceptive because it lacked constitutional substance, and was defended by an inherently weak union of the Inner Austrian estates. Dr Pörtner analyses the aims, achievements, and shortcomings of the Habsburgs' confessional crusade in Styria, showing how although the progress of Protestantization was reversed, the Counter-Reformation left an ambivalent legacy to the modern Austrian state.

'Peace' is often simplistically assumed to be war's opposite, and as such is not examined closely or critically idealized in the literature of peace studies, its crucial role in the justification of war is often overlooked. Starting from a critical view that the value of 'restoring peace' or 'keeping peace' is, and has been, regularly used as a pretext for military intervention, this book traces the conceptual history of peace in nineteenth century legal and political practice. It explores the role of the value of peace in shaping the public rhetoric and legitimizing action in general international relations, international law, international trade, colonialism, and armed conflict. Departing from the assumption that there is no peace as such, nor can there be, it examines the contradictory visions of peace that arise from conflict. These conflicting and antagonistic visions of peace are each linked to a set of motivations and interests as well as to a certain vision of legitimacy within the international realm. Each of them inevitably conveys the image of a specific enemy that has to be crushed in order to peace being installed. This book highlights the contradictions and paradoxes in nineteenth century discourses and practices of peace, particularly in Europe.

The late Middle Ages saw the emergence of professional jurists as a new functionary elite. The study approaches this phenomenon by focusing on a singular individual: Dietrich von Bocksdorf, Professor of Canon Law in Leipzig, learned counselor to the elector of Saxony, bishop of Naumburg. The book thereby breaks new ground. It offers not only a biography, but explores large and previously unused and largely unknown collections of more than 500 papers from the legal practice, written by the Leipzig Ordinarius. Based on this unique material the book examines for the first time spheres of influence, circles of clients and occupational fields of an individual late medieval german jurist. Legal opinions (“consilia”) and pleadings, but as well working tools for the emerging learned practice of “Common Saxon Law” made by Dietrich von Bocksdorf, provide deep insights into the beginnings of the epochal change from the traditional-archaic jurisdiction of the Middle Ages to the scholarly and written practice of law in the early modern world.
